i dont know what's sadder
that we have such nitpicking amongst LEOs regarding how many ways they can ticket a driver
or we have drivers that actually care about such stupidity
if you are offf-duty, that means you are not connected to the truck
if you are in the sleeper (anywhere in the truck, but not working on the truck) you are sleeping
i cant imagine, getting up in the night, going to the bathroom, and then coming back into the sleeper as "breaking my 10 hrs of continuous sleep" and i must log that off duty
surely you had to sit in the front seat to put on your shoes

You do know that you could log 15 minutes in the sleeper, then 15 minutes on duty, then 15 minutes in the sleeper.... for your entire 10 hours, and be legal to drive? you have met the requirement of being off duty for 10 hours... there is NO requirement of being asleep for 10 hours.

correct me if I'm wrong but I thought you had to have at least 8 hrs in sleeper?

If a LEO woke me up in the middle of the night at a truckstop, I would crack my window, hand him a urine sample, a blood sample, a finger print, my log book, and BOL, and say, here you go, should be all you need, leave it on the step when your done......we'll keep the blood and urine. When will the madness end!

I once had a scale master question my logging my full 10 (might have actually been 11-ish) in the sleeper without showing any off-duty for going to the washroom. I told him I piss in a bottle, #### in a bag and whack off in a sock, which one did he want? After a brief, but severe silence he slammed my book shut, slid it across to me and told me to leave... or words to that effect.Cetane+, passingthru69, haulhand and 2 others Thank this.

only time 8 continuous hours is required is when you are using the split sleeper break, of 8 hours in the sleeper, and 2 hours of off duty or sleeper... Otherwise, the only requirement is 10 hours of off duty/sleeper time combined...

Correct me if I'm wrong, but if you are teaming then you need to show 8 hours sleeper berth. Off duty in a moving truck means you aren't in the sleeper, sitting in the jump seat.

you are partially correct, for team drivers... while the truck is moving...
*A. Definition of On-Duty Time
The FMCSA is excluding from the definition of on-duty time (i) any time resting in a parked vehicle, or (ii) up to 2 hours in the passenger seat of a moving property-carrying CMV, immediately before or after 8 consecutive hours in the sleeper berth.
any passenger-seat time in excess of 2 hours would be considered on duty/not driving. Revised on February 13, 2012.
