Canada/US HOS question.

    I'm parked at the border to cross into the US. I got stuck in some nasty Toronto traffic and wasn't able to make my planned stop for the night. So I'm taking 8 hours of rest off at the border (legal according to Canadian rules) once my 8 hours is up I will cross into the US. Will I be in violation once I enter the US? Or will I have to take the full 10 hours off on the Canadian side to not be in violation when I enter the US. I contacted my company about it and they said I should be legal after 8 hours as long as I take 2 hours off sometime during the day tomorrow. Any thoughts?

    edit: I had 4 hours left on my 14 hour clock before I switched to sleeper.

    How many driving hrs have you burnt that day? I f you had 11 driving hrs you have nothing left after 8 hrs break, you will need a ten. Your 8 hrs sleeper only extend your 14 to 22 hrs.

    If you couldn't cross because you were out of time the 8 will do nothing for you.

    I had a total of 4 hours left before I switched into sleeper.

    Your company is right, however that only satisfies Canadian HOS. Because you are crossing the border, your consecutive 8 will only quality you to use the split sleeper provision (US HOS) rather than resetting for the next day, subject to what The Kraut (hahah) said.

    Best bet, just log 10 straight if you can, and carry on with a fresh us log day.

    My total on duty time in Canada was about 10.5 hours. 10.5 of the 14 hours. I had some time left, but wouldn't make my 10am delivery in Liberty PA if I drove into the night.

    I see, how does sleeper provision in the US work exactly? I learned US HOS in orientation but they weren't very thorough on it. I'll probably just end up taking the 10 hours off.

    So the max you'd have available is 3.5 hours but I doubt only 7.5 of the 10.5 were driving so probably less than that.

    Ok, take 22 hrs from the time you started your clock this morning. If you started at 8 AM this morning you can have 22 hrs with 8 hrs sleeper, that's 6 AM tomorrow. In this 22 hrs you can drive your 4 hrs you had left today. (If it was 4 driving hrs left)
