Company deducting money. Need advice.

    Hello everyone.
    Last month I picked load from Texas. I had to use emergency brake because truck infront of me did the same. There was 2-3 truck distance between us. My load moved. I informed my company the told me to get back to shipper and set the weight again. I think they did not inform the insurance because there was minimal damage. After one month the customer send the claim to my company. And they are deducting my pay by saying insurance is saying driver is at fault. Is there any way I can get sure that they actually filed the claim and are speaking truth. I hv seen the samsara video. I was looking straight not even distracted by anything.

    Are you company driver? Is so, should not deduct wages. May deduct safety bonus and other bonuses not considered normal wage. If you are 1099, look at what your contract shows.

    I am company driver. They have it in my contract that if driver is at fault then deductible will be charged. Bt I dont think anybody even filed the claim. Because after I informed them and my owner told me to go back to shipper and they gave us new load. Nobody mentioned it again. I remember few months back a car hit me from back that time they told me they need to file a report so they need all details like where it happen or how , all that.

    I am in canada. Its a LMIA based work permit in which I can work only for them.

    Gotcha - Canada. LMIA looks to be the equivalent of a US based H2B work visa.

    So, you can only work for them?

    Where are you from originally? How did you get to where you are now?

    I am from India. I had driving experience from UAE. The owner here in my company is also from India. And they had pre approved LIMAs ( permission to recruit employee from other countries for specific specific due to shortage) . Some mutual contact introduced me to them and I sent them my resume. They hired me. Now I have 3 year work permit which is locked with them only and in same profession until I get PR in canada.

    If you find out they never filed any claim with insurance what will you do?
    If you find out they did file insurance claim what will you do?
    If you are stuck with this employer for 3 years, what can you do?
    I thought slavery was illegal, except in Saudi Arabia.
