I am in between again looking for a new OTR position. I just paid for an MVR from the state I had a license in for most of my life and it said no citations one three month citation 7.5 yr ago ( the last 2 years my CDL in another state with a clean slate). I was surprised there were a couple of citations not on the official State MVR. This was prior to having my CDL. Last week I was vetted by a company that goes into Canada, and turned down because of a DUI 38 years ago when I was 19 and another one in 2001 that was dropped because the blood teat cleared me but the official report told that there was "no disposition" and was told the interpretation could be that it could go either way. I was under the belief it was dropped completely. How is it that my MVR shows no citations with one suspension for three months. I have already been through the vetting with Swift and was hired drove a year and I want to look for a better fit and want to disclose everything. I have had tickets 3 yr and more than 5yr I did a plea in abeyance for, which shelved it until the probation period was over then it was supposed to disappear like it never happened and for the most part has proven true except the data base the Canada uses to see you back to birth.!:smt102 From what you have read what is the proper and honest info to give on a new application.

You answer the questions truthfully. Don't give too much but don't leave any out either. If they ask if you've had a DUI in the past 7 years then you can say no. But if they ask if you've ever had a DUI then you would say yes. Those are just examples because if you were cleared then you're not guilty. Don't try to split fine hairs here because it's only guilty and not guilty there are looking at. If you have any conditions on your ticket when it went to court then you're guilty. I've never heard of a ticket with a charge of maybe.

If I were you I'd get a lawyer and clean up your record. Know exactly where you stand. And check all the states that you had a license in. Sometimes the states do not check the other states for your record but the companies will. And here's the bad news. If you lie on an application and they catch you they will brand you and you'll never get a job driving if that happens.

Thanks FYI in Utah most Gov. entities a person can enter a plea in abeyance which I would be accessed the full fine to the citation however it is shelved for a probationary period of 3mo, 6mo 1yr. At the end of the time specified and I did not break any conditions of the probation the citation is dismissed. So if I am clear on what you have stated I would disclose these types of citations and say they were dismissed. I appreciate that if you are unfamiliar with this kind of arrangement you will not be able to answer me. It seems like some companies use different data bases because some have more informatin to share than another. I will play it safe and disclose everything saying that some have been dismissed.
