Kind of odd, a carrier near here has been dinged by the state for abusing this because everything they shipped for the past year has been under this exemption when it wasn’t.

See, they can give us freedom to drive how we see fit, they just won't do it. Example:

    1. Motor carriers shall not require or allow fatigued drivers to operate a commercial motor vehicle. A driver who informs a carrier that he/she needs immediate rest shall be given at least ten consecutive hours before the driver is required to return to service.

...because it would cost them way too much money in lost traffic ticket revenue, as Montana found out when they tried switching from having numerically defined speed limits to "reasonable and prudent" a few years back.

Not sure this is related but... from Landline Mag site. Seems like maybe some carriers gonna have some 'splaining to do.

"Motor carriers who are voluntarily operating under the FMCSA’s COVID-19 emergency declaration will be required to report the number of trips in which they used the exemption."

FMCSA emergency declaration reporting requirement due Oct. 5

So now they want you to run a log book on exempt loads but 395.3 is still part of the exemption. Brilliant. Lol.
