    But if they are cited for a violation and did not participate in the loading process, their primary recourse is for their employer to file a civil complaint against a shipper.

    The problem is, the FMCSA has no jurisdiction over shippers, and no recourse if the shipper tells the FMCSA to pound sand. They aren't licensed, and have no operating authority which can be revoked. They'll file that complaint in the circular file and carry on business as usual.

    Pretty much the same deal with this coersion nonsense. A sternly worded letter is about all the agency can send, because they have no means to apply pressure (and the shipper/receiver no reason to pay) any alleged fines. The broker (who has operating authority which can be revoked) is about as close to the shippers/receivers that the FMCSA can get.

    I'd love to see them fine a flatbed shipper for securement...LoL
    As for van drivers, you dont secure your loads, anyway, save for a couple load locks or a false bulkhead. Maybe they should try to fine some of the companies that ship tall paper.
