That part of 391.51(b)(6)(i) has been superseded by a dated change in 391.43(g)(2). That section is confusing, and to be 100% honest is written poorly. I am making bold the part that really matters. The DOT/FMCSA changed that part because drivers W/O a CDL still need a Medical Card to operate a non-CDL CMV. Their medical card information is NOT available to the states as it is with CDL holders. Now carriers are required to add the the drivers medical information directly from the CDLIS to satisfy 391.51(b)(6)(ii)

On or after June 23, 2025, if the medical examiner identifies that the person examined will not be operating a commercial motor vehicle that requires a commercial driver's license or a commercial learner's permit and finds that the driver is physically qualified to operate a commercial motor vehicle in accordance with § 391.41(b), he or she must complete a certificate in the form prescribed in paragraph (h) of this section and furnish the original to the person who was examined. The examiner must provide a copy to a prospective or current employing motor carrier who requests it.

Now, as I stated in post # 24, a carrier is still free to require a long form and make a job offer contingent on that driver supplying it. But the rule requiring the long form to be in the DQF has changed.

You wasted a lot of time on this garbage none of this has anything to do with fmcsa or dot regulation. The only people who are required to have your long form physical on record is the medical examiner and they can not release that to anyone without your signed consent or a warrant for that information. I have no idea where you got hippa or the constitution doesn’t apply to truck drivers it only doesn’t apply if you surrender your rights.Even to a Year and a half ago when I did my last physical the only thing I had to send to the DMV was the (MEC)the certificate saying I passed and how long it was good I didn’t send a long form to anyone.

Show me where that regulation is that says a carrier has to have a copy of a long form physical for their drivers bet you Will surprised when you learn that isn’t true.Nobody has a right to your medical records as of California now a cop has the legal right to ASK for anything and even the right to lie to you that doesn’t mean because they say it that’s a lawful order if you know your rights you don’t have to comply with an unlawful order .it’s up to you to know what your rights are and if you don’t and surrender them on your own ignorance that is totally on you.Nobody has a right to see your long form physical
