I didn't take YOU "to Court", in fact the DLEG (Wage and Hour Division) didn't either, and WONT unless you refuse to pay them what they ORDERED you to pay for violating at least TWO Michigan Labor Laws (as evidenced in the photos I posted). EVERYONE here KNOWS it is against the LAW to write a check on an account that doesn't have the funds to cover it. And everyone knows it is ILLEGAL to deduct from an employees paycheck UNLESS the employee "gives written permission". THOSE TWO actions are BOTH CRIMES. You know that as well as everyone else.

I filed a COMPLAINT and the DLEG investigated and found my story to be truthful (WHAT defence did you have for breaking LAW, anyway?) And YOU filed an APPEAL, for which YOU LOST and the original finding by the DLEG Investigator was UPHELD. The evidence is found in the photos I posted. Everyone knows it, and you loose credibility by denying it.
If I am "slandering or libeling" you PROVE it, put your money where your mouth is and SUE me. (YA-right like THAT will happen). You found someone who won't cower and give you YOUR way whenever you throw a hissy-fit and it gets you very angry.
I didn't "demise", in fact I have a good job down here working between Mississippi and Louisiana, making more money than YOU ever promised, and for someone who appriciates my work and doesnt scream and cuss whenever he has a "bad hair day" as YOU do. And FURTHER, I never "stormed" out of ANY hearing, but was there from BEFORE you got there until AFTER you left. SO, tell your fairey tales to your group of faireys, cause no-one here believes it. Your reputation preceeds you (on websites other than mine)

 

From the emails I am getting, quite a few of them are SORRY they called you. Something about DAMAGES not paid for, unanswered calls, not returning their (exorbandant) deposits when they find someone else, or the fact that you cussed and screamed at them (or their boat-yards) when things didnt go YOUR way. Perhaps someone should call Mr. Alex Alizajeh in Murrieta CA, and ask HIM how you talked to him?

Ya sure, you called ME 4 times after I applied for the job and wanted me to quit my job RIGHT AWAY and work for you, no "2-Weeks Notice"...nothing. Then you called me again the night I was supposed to start working for you because I was 15 minutes late (Detroit traffic, naturally).

Unshaven and unclean??? LMAO.....I have had a full beard (neatly trimmed) for over 25 years, I put clean clothes every day. I have not ONE, but TWO photos posted in this furum proving just that. One is in my profile taken over 4 years ago, and the other one was taken last May in Slidell LA.

NOPE, I have NEVER owned a Kawasaki. What I was riding was a 1982 GL-1100 Gold-Wing STANDARD. If you "liked" motorcycles, you would know that this is a Classic Honda, only made 3 years. And It wasn't a piece of junk, as I had just had it repainted, although the "John Deere Green" might have thrown you off.

Oh yes, like YOU really have that many choices, since you have the reputation for chasing your DRIVERS (and customers) OFF, you seemed pretty eager to hire me.

I pointed out that according to DDL (and the records have REMAINED unchanged since the program created them) FROM AN EARILER POST:

You should note that the (26) days DID NOT include those times I was home on an occasional Sunday, does NOT include the 1/2 day I sat in Kentucky because you hadn't ordered the Tennesee permit, or the 2 1/2 days I sat in Tennesee because YOU did not order the permits for Alabama or Mississippi in time on Friday and DID NOT even order the permits until Monday. (THAT was all on THE SAME TRIP!) Nor does it include the 34 hours I sat in Arizona when I ran out of hours. But also, don't forget to tell everyone here how you yelled and screamed and cussed me out over the phone because "your customers are the more important" than your drivers, and that I HAD to be in San Antonio first thing the next morning (from Eloy AZ...only about 920 miles!). Also, don't forget to mention that when I called the customer, they were pretty ambivilant about it and told me to get there when I could. Also, I do not believe that I logged MORE than 4 hours LOADING any boat, and THAT boat took particularly long because there weren't enough of the right pads to use on that boat. You told me that YOU only log 15 minutes to load ANY boat. That is indicitive of FALSIFIYING Logs, if you DON'T log it as YOU DO it, then you are BREAKING a Federal Law. Which I told you time after time I would never do. Not for YOU, or anyone else. I told you repetedly that I was going to log it as it happened. And YOU didn't like it.

 

Wrong Again! That "form" CLEARLY states that YOU were ORDERED to PAY ME $1801.50 PLUS $.49 PER DAY (starting the DAY I filed the complaint, until you paid), as well as pay a "Civil Penalty" (fine) of $900.75 to the State of Michigan.
YOU are the one who filed, NOT ONE appeal, but TWO. You withdrew the first appeal and filed a NEW one. YOU are the one who LOST, I didn't lose anything, except time from work down here on the Gulf Coast, travelling to Michigan. YOU lost because YOU broke Michigan Labor Laws.....plain and simple!

Also notice in the Section indicated by the words: VIOLATION STATEMENT
it clearly says thet the State of Michigan DETERMINED that YOU violated sections 5[2] and 6[1] (Michigan Labor Laws).

David Derderian NEVER tells the "truth", full or otherwise.
You are quickly loosing any credibility you think you had here.

 

If DRD/David Derderian DISPUTED the determination of the Michigan DLEG, then WHY did he write THIS check dated December 30, 2005?
You will notice that IF you add the amount on the Check($412.37), PLUS all the TAX with-holding, you come up with $1805.50. That is what the State of Michigan DETERMINED that he HAD to pay in November 2005. Also consider that David Derderian, BEFORE the State of Michigan determination NEVER withheld from my check ANY amount (violating other laws, both Federal AND State) and in order to "get back at me", he with-held ALL due taxes from this final check. It remains to be proven if he ACTUALLY did pay the taxes he reported. So, if "HE WON" at the March 14, 2006 Hearing, as he claims, why did he write this check December 30, 2005?
