Wanted to see if there were any ways around this scenario. I drove Denver to Livingston, Mt with 2 stops in Sheridan and Billings along the way. My hours run out in Livingston. I'm shut down until 6am next day but the weather forecast shows a snowstorm coming in at midnight and is going to dump for 24 hours straight. My next drop is in Bozeman which is 30 min farther west over a pass. Is there any way to legally drive 30 more minutes on dry roads to get to Bozeman or am I just screwed? Using elog plus. Just don't want to have to drive thru crap over a pass if I don't have to.

You can use adverse conditions to drive an additional 2 hours. The catch is you cannot drive past the 14 hour mark. Meaning your 14 hour clock still stands but you are allowed to drive up to 13 hours in the 14 hour window.

Question 5: How may a driver utilize the adverse driving conditions exception or the emergency conditions exception as found in §395.1(b), to preclude an hours of service violation?
Guidance:
An absolute prerequisite for any such claim must be that the trip involved is one which could normally and reasonably have been completed without a violation and that the unforeseen event occurred after the driver began the trip.
Drivers who are dispatched after the motor carrier has been notified or should have known of adverse driving conditions are not eligible for the two hours additional driving time provided for under §395.1(b), adverse driving conditions. This is a major reason why the HOS need to be overhauled. Forcing a driver to sit on one side of a pass until after a storm hits then making him run it in bad conditions is asinine.

You are the driver. You decide if it is safe to run it or not. If you know the pass is too rough, stay put.
