Firearms in truck

What you have stated is correct in carrying a gun in your truck or car with out a ccw permit. All the conditions that you stated have to be met, you are protected by federal law, and it's federal because you are going across state lines. You can call the NRA which i am a life member of and get the name of the law that protects you. You ask what good is it if you have to lock your gun up, I say why do you have to keep a loaded gun in your truck just to drive down the road, it's not that bad out here yet and you are not really a target while driving just when you are parked. Back in the early to mid 90's i carried a .45 in my truck and when i parked i loaded it and in the morning even before taking a shower i unloaded it and put it back in it's case. And just so you know, if you carry a pistol you have to have a m/t mag in it. Law Enforcement could look at a pistol with out a m/t mag in it as not being legally assembled, it sounds goofy, but it is what it is.

I'm pretty sure i can never legally have a loaded gun in my car in MD. We don't issue concealed carry permits.

There is NO federal law prohibiting possession of a firearm in a commercial vehicle. Period! That is a myth that has been around for years. Although some companies and driving schools make reference to the federal law in their handbooks, it does not exist. If you run across someone who insists it does exist, ask them to show it to you. There are most definitely company policies against possessing firearms in their trucks, and that is an issue between the driver and company. In addition, gun laws will change from state to state in your travels. It is a good idea to check the gun laws in the various states you intend to pass through before going.

There is NO Federal Law saying that it is illegal, only city, county and state laws that make it illegal to do so.
(and the policies set forth by the "companies" are NOT "LAWS", just rules.)

Sec. 926A. Interstate transportation of firearms
Notwithstanding any other provision of any law or any rule or
regulation of a State or any political subdivision thereof, any person
who is not otherwise prohibited by this chapter from transporting,
shipping, or receiving a firearm shall be entitled to transport a
firearm for any lawful purpose from any place where he may lawfully
possess and carry such firearm to any other place where he may lawfully
possess and carry such firearm if, during such transportation the
firearm is unloaded, and neither the firearm nor any ammunition being
transported is readily accessible or is directly accessible from the
passenger compartment of such transporting vehicle: Provided, That in
the case of a vehicle without a compartment separate from the driver’s
compartment the firearm or ammunition shall be contained in a locked
container other than the glove compartment or console.

 

Thanks for setting it straight.I know if people are not involved that much in firearms or the laws they get misguided information. I guess it's the same thing as the new drivers out here saying they had the U.S. marshal's office storm troop the ship/rec. office because they were treated bad or something like that, geeez

 

You can but you must make certain that every single state you drive through recognizes the concealed carry permit from the state that issued it to you. Many states that have concealed carry laws do not necessarily recognize permits from every other state that allows concealed carry. It can be very confusing and could result in a felony conviction so I would not advise it.

 

Wow. This thread started over 5 years ago.

Over the next 2 years, there will be alot of state going to Constitutional Carry.

I have heard rumors of the possibility of a Federal or National Carry Permit that would allow you to carry in all the states.

There is no way that I will have time to read every page of this thread.

I never thought I would find a trucker that was not a 2A supporter. My eyes have been opened.

I like to keep a loaded pistol in my hand gun, just incase i need it.
you never know what your going to come across out on the road.

Hell i might even have to put a deer out of its misery after i hit it.

But I always assumed that doing this was illegal as hell. Which it is in MD.

But when i was in TX, i guess that was legal.
