Here's my problem w/o being political, safety on the roads shouldn't matter who you are. A family on the road next to a semi should be able read the signs and not have worry about a truck ramming his way because hes afraid he will miss his exit because his GPS said turn here...The problem i see is what will happen in the next administration. I don't care about sides I care about any politician who will lie to win a vote whether red or blue I care about what's gonna help my family, my livelihood. I tell my relatives GTFA from every semi you have no idea what you driving next to you half the things i see them do makes me question why more hasn't been done to stop texting There's a simple fix and it involves companies imposing no texting while driving. It wouldn't even be hard. The tech is already in, just not activated...

Duffy just audited the biggest violator, CA, and found 1/4 violated the law. All the examples he gave were of licenses with expiration dates that did not match visa dates; so basically a clerical error.
200,000 non-domiciled CDLs, with only 1/4 violations of a clerical error that is easily fixed, does not add up to taking 200,000 CDLS off the road. Especially, when Duffy is giving those involved 2 years to fix the error.
Duffy did a Friday press release, because like all Friday press releases, it was pure BS. Politicians know the press will not fact check BS on Friday afternoon, and the rubes will forget what was actually said over the weekend.chimbotano and gentleroger Thank this. -

Much more and worse than a clerical error. Non-citizens should have never been issued a CDL. They will not be renewed at expiration. The system was abused.
"Non-domiciled CDLs were created for U.S. citizens who lived in jurisdictions that had been stripped of their ability to issue CDLs, he added, and the new emergency rule restores the practice to its original roots. "
"As such, an Employer Authorization Document "alone will not be sufficient to obtain a CDL," he said. Now only H-2B, H-2A and E-2 visa holders will be able to obtain non-domiciled CDLs and "every single issuance and renewal" of the CDL must go through federal databases and happen in person."

Duffy "misspoke". The first Trump administration clarified that foreign drivers were eligible for non-domiciled CDLs, provided they were authorized to work.

This interpretation was based upon:
"On July 21, 1988, FHWA published another final rule, also titled Commercial Driver Testing
and Licensing Standards, which defined the term “State of domicile” as “that State where a
person has his/her true, fixed, and permanent home and principal residence and to which he/she
has the intention of returning whenever he/she is absent.” 11 This definition is consistent with the
generally accepted definition of the term domicile.12
The July 1988 final rule also further amended part 383 by adding 49 CFR § 383.23, which
provided in pertinent part:
(2) Effective April 1, 1992, except as provided in paragraph (b) of this section, no
person shall operate a commercial motor vehicle unless such person possesses a
CDL which meets the standards contained in Subpart J of this part, issued by
his/her State or jurisdiction of domicile.
(b) Exceptions. (1) If a commercial motor vehicle operator is domiciled in a
foreign jurisdiction which, as determined by the Administrator, does not test
drivers and issue a CDL in accordance with, or similar to, the standards contained
in Subparts F, G, and H of this part, the person shall obtain a Nonresident CDL
from a State which does comply with the testing and licensing standards
contained in such Subparts F, G, and H."

That's my biggest problem with this burst of 'enforcement' - it does nothing to improve the quality of the drivers entering the industry. Regardless of citizenship/immigration status every driver passed the same CDL test which is not rigorous. It test comprehension, not competency. New drivers memorize what the answer looks like so they can identify the right choice on the multiple choice test. They learn how to parrot off the pretrip without actually looking at the components. I cannot count the number of trainees that have touched or pointed at a light that was not illuminated and said it was functional. The road test takes them down roads they've driven down dozens of times, then they go somewhere else and can't safely navigate turns.

SE Asia, Polonesia, and some African cultures are the main sources of single names. To the best of my recollection, it works a lot like Irish/Scandinavian/Russian hereditary names. Pat McBride is the son of Bride, Pat's son would be Dan McPat, Dan's son would by Liam McDan, etc. The difference is it's all contained in one word. The non-domiciled CDL was exactly made to give non-citizens CDLS.
The exact rules Duffy put in his press release, were actually written in the FMCSA by Congress in 2011.
It was a response to a human trafficking scheme that was busted in WA state. After the CDL fraud scheme that killed 6 people in Illinois, and got Governor George Ryan thrown in jail, the Bosnian, Ukranian, and Russian mob moved there human trafficking schemes to WA, PA, and FL. These states would not only allow and interpreter for a foreign national to take the CDL tests. But, in the case of WA at least, would pay with taxpayer money, for the foreigner to take all the tests with a language interpreter. It turns out the interpreter got really good at taking the test. The applicant not so much.
No, that was the cover for the scam of non-domiciled CDLS. Non citizens were always the whole objective of the law. The non-citizen was always in the rule. In fact in some states this was called the non-resident CDL as well as other names.
This has always been the case.
No, always has been the case since the start of the law. Exactly nothing new. Duffy is lying saying any different. He is just pretending like he is doing something other than refusing to enforce the rules for the next two years.
So we have Duffy finding 25% clerical errors in the state likely to have the most violators. 25% of 200,000 non-domiciled CDS is 50,000 drivers. BUT DUFFY GAVE EVERYTBODY TWO YEARS, to get there paperwork in order. So likely no one will loose their CDL In the next two years thousand more non-citizens will get CDLS.
Non-citizens H-2B, H-2A , and E-2, are NON-Citizens will all get CDLs. Just like before.
Before you get bent out of shape reading this, let me be clear on my position. I think you need to be an English speaking citizen to have a CDL Nothing less.chimbotano Thanks this.
