fuel costs - who pays

    Should I be paying for fuel? I'm 1099 and I'm a company driver. My boss fined the load and 99% of my loads back home are deadhead. Fuel is taken off of the total before getting paid. This doesn't seem right. I think he should charge more for the load if he can't find a load back as it's his responsibility to find me loads. I think if he can't find the loads he should cover the fuel. Also shouldn't the fuel surcharge cover the fuel loaded so I don't pay for the fuel? If a load pays 2800 and I spend 800 in fuel I get a % of 2,000 that doesn't make since to me. I feel like my boss is making way more on the loads this way and its not worth my time. Also some loads are out of state very far not paying much and I still have to take it when he knows we don't have a load back. Please help.

    Not going to sugar coat this, it seems you and a lot of other drivers are clueless to what is an employee.

    Quit, stop working for POS owners like this.

    AND next time, have the contract READ by a lawyer if you can't understand it. The contract is all that matters, it is not what you think or the owner thinks who should pay for fuel - which he should be - but it dictates the relationship you both have.

    They are trying shove the cost of the whole operation onto you and pocket as much as they can for themselves. You’d be better off frying Nuggets at McDonalds for $15/hr and that is probably not much of an exaggeration.
