Have You Ever Needed an Attorney Due To Happenings on the Road?

Yes.... Charged with Careless Driving in Portland OR in an 18 wheeler. Hired a lawyer in Vancouver who specialized in vehicle or vehicle related. He was licensed and did alot of work in Portland. It was actually Beaverton. Cost me $700. In the end. Put it off so long. I don't think the cop liked writing me that ticket. I rationalize he was ordered to. He quit the department. All charges dropped.

 

I left Waco one morning. Couldn't get anything quick out of Denver. It was Thanksgiving day when I left. Decided to take the scenic and more straight through route to Denver. Boy was that a mistake. Ran into a Highway Patrolman who was mad he had to work Thanksgiving. He was handing out tickets left and right. He wrote me a ticket for following too closely. My dashcam clearly showed I didn't follow nobody. Much less too closely.
I know those small Texas towns. They'll convict you just because they don't like you. I hired a lawyer out of Austin. This was about 79 miles west of Austin. I forget the name of the town. This guy really knew how to play the Texas game with the courts. He cost me $2000. He had to appeal it to a higher court. The local court couldn't let it go without a trial. He wanted to avoid a trial. Wanted to avoid my having to come back down there just for a trial. The A hole Prosecutor in the higher court demanded a fine be paid. Marked it as traffic school. Dropped the ticket. Ended up a total of $2500 it cost me.

BTW: Lawyer passed on information from me that the Cop was writing tickets like mad. That lower court did say they appreciated the testimony.

 

I would highly suggest to you. On anything, anything at all. Hire a lawyer. Try to find one that knows what he's doing. I rationalize in OR, he knew what he was doing. Department with high turnover? I was up against a Judge there who hated truck drivers. She would reject plea deals that the prosecutor agreed to. It pays to have a lawyer who specialized in traffic and trucks.
Oh....look it up. That Careless Driving ticket was a pretty mean one. It would have knocked me out of driving, period.

 

Back when I drove a trash truck here in Rapid. Ran into a completely squirreled out Highway Patrolman. He was obviously new. I could see him driving in the grass along the freeway. Then watched him pull up on the shoulder of the freeway. Position his car there and stop. His yellow light was running the whole time. That meant his dash cams were on. Front and back. He stopped right in front of my exit. I had to exit there. I didn't pull over into the other lane. Had screwball problems with traffic too. He pulled me over. On the exit.
This punk was completely squirreled out. I rationalize he had too much energy drink that morning. He'd bounce around, looking into my truck. Acting like I should immediately pull out registration and insurance. As if I pulled it out everyday.
I first complained to his captain. Told him the guy went too far. I had to exit there. The Captain screwed up big time. He wrote me a letter stating that the Patrolman was there after a pull over. His own dashcams busted this lie. Conveniently, the Highway Patrol didn't have the video no more when we went to trial. I hired a lawyer. I also demanded he subpoena the Patrolman's last pull over. No way he pulled her over there. I remember the gal going in front of a great judge. Asking him if this subpoena was real. He told her yes and couldn't give her details of why. My lawyer ended up taking care of it with the prosecutor. I was put on "probation" for 6 months. Nothing and the ticket is dropped. Anything at all and they'd prosecute this. I wanted badly to go into court and shove that ticket up the Highway Patrol and Prosecutors ###. That gal would have killed them. Unfortunately, it never happened.
I remember that 6 months. Whenever I saw a cop. He would just turn his head and drive away, take the turn or whatever.
I remember going to pre trial. Telling this great judge....Who in the hell gave this guy a badge? He's completely flipped out and incompetent. I remember seeing him between the pull over and court. He would stick his face in the windshield and glare at me. he disappeared after that. I don't know if they let him go or transferred him or what. He wasn't around no more. I rationalize I wasn't the only bad ticket he wrote. I rationalize they had a bunch of trouble over him.

 

I had a bad problem at the Air National Guard at the airport when driving the trash truck. It was Rally Week. All of us truck drivers were trying to get done early and get off the road. The Air National Guard is also the gate for the Firefighting Tankers. I tried to go in about 5:30 am? This guy stopped me. Started yelling at me that I wasn't going no where. Now get out of here! While winding his body up and pointing toward going in. ...In the process. The gal showed up for days who knew me. She told him; Who in the hell do you think empties those dumpsters?! I ended up going in.
This was a new security guard company. Prided themselves on being hard nosed to everyone. Another day I ran into the guard's boss. He was awful. I told him I can complain to the CO. He said; You're not going in there! I can't go into my customer's office and talk to him? I could have called the CO and brought him out to the gate to talk to them. I had his phone number. He was my customer.
Anyways....they raised a big stink. Owner of my company talked to me. I told him what happened. I also told him to tell them that I'm registered with the Department of Homeland Security. I have a Hazmat endorsement on my license. Told him about the gal yelling at him as to who the hell he thought emptied those dumpsters. He had said: I thought he was in the wrong place. Told him it turned comical at that point. Completely laughable as she took over the gate. He had to be the worst security guard I have ever run into. Tell the CO that.
The owner of my company also understood that I was just trying to get done early. All of his drivers do the same on Rally Week.
Then things cooled off.
Later at a company Christmas Party. The owner of my company asked me how things turned out. I told him, they completely redid how the night guard works. Now he has to come inside the building. Be approved by all inside. Then he sits there inside monitoring the gate about 100 yards away all night long. If someone comes to the gate. He has to walk out there to open it. That can be not swift at all here during winter in SD. My owner smiled. Apparently the CO didn't like what the security guard company pulled.

 

Sounds like an attorney drumming up business.....

Somewhere in the distant past they used to offer a pre paid legal service for drivers. Mostly for traffic type tickets.
They were as prevalent at truck stops as a roller dog now.
Had it for a few years and in 87 got pulled for running a red light. Cop was coming at me from a quarter mile away as I entered on yellow.

Beat that ticket w a local lawyer from the network. I think he was from Pittsburg, KS

That was the last moving violation I received.

Was happy to have it when I needed it but have never hired a local lawyer for an on the road incident.
