Hefty overweigh citation, how to proceed in court?

    Talk to your company, it is a ticket that carries no points or penalties other than a fine.

    I got a $2k overweight ticket in Colorado years ago, as per the issuing officers advice I contacted the court asked for a reduced fine. Being a first time offender they cut the fine to just under a grand. I didn't try to make any excuses and just admitted to my screw up. Its worth a try .

    I would do what the DOT officer suggested, plead not guilty, and be honest with the judge and tell him/her that you forgot to drop both axles.

    Years ago was in Colorado with an oversize/overweight crane, got stopped and escorted to train scale. No ticket. They made the shipper come out pull 1 of the winches and cable out. Rescaled and went on my way 1.5 days later.

    Tickets can be reduced.

    Fines usually aren't.

    No harm to your license. Chalk it up as lesson learned.

    Trying to take it to court is just more money to the fine. And time off from work. Loss of pay.

    Sarcasm with a lot of truth. Call an attorney not a bunch of guys on their 10 hour break in a parking lot. Most of us are here to laugh and poke fun with the occasional pearl of wisdom.

    @TripleSix and @D.Tibbitt gave the best advice here. Also please pay more attention to what you're doing whilst out here. Letting home life get in the way of doing your job safely could get real bad, real fast! It's happened to the best of us and luckily, in your case, no one got hurt.

    Some of us have been in the same boat as the OP, well, at least I have. Seeking advice from people who have been in similar circumstances can help. In his case, he may not be able to afford to pay a lawyer even a few hundred bucks to handle things.

    I had a situation a few years ago where I was facing almost $1500 in fines, my own fault and was broke. Couldn't afford to hire a lawyer either. I called the courthouse and spoke to the clerk, explaining my situation. She mailed me some paperwork, I filled it out and mailed it back. A few weeks later, the fines were reduced to $0 + a $10 court fee.

    That's not playing truckstop lawyer. That's one driver sharing from experience so another can decide which direction they want to go.
