i having been working ALLOT, 28 days consecutive driving everyday. i was wondering if i am in violation, although i would never get caught without a log. i work 8-10 hours per day so i might actually not exceed the 60 in 7 but it would be close. circumstances in my life recently have required me to make as much as possible, i can gross $1250 and be home everyday. i have been getting a decent amount of rest. i dont normally see the D.O.T. on my route. making $1250 per week working 8-10's and home daily im pretty content with that, although i eventually will be taking a few days off here and there.

Don't you have an eld? If not it's not hard to keep up with your hours on recap.

If I am not mistaken I understand you are a local radius driver. The HOS does still apply to you. Just the way it is recorded is different. I suggest you watch that weekly hour total. The FMCSA have done compliance audits of local companies. They will want to see some of those time records in such an audit!. Just saying!

I take it you are on a timecard?

You atill have to follow the 11 and 70 hour rules. You cannot work more than 12 so the 14 is moot, and the 30 minute break does not apply.

If you are required to keep logs then you should already know the answer to your question.

IF you are keeping accurate logs...

Does milk qualify under the ag exemption? They get to play by some ridiculously lax rules. If so, you're fine.

I forgot about that that. Yea he hauls raw milk so during planting and harvesting season hos does not apply as long as he stays within 150 mile radius. New York defines said season as year round.

The only hours that count towards his 60/7 are the ones outside of the 150 radius. He could work 16 hours inside the radius and 8 hours out of it and be perfectly legal for the day.
