    It did.

    But when running a chance at split log, you need the 8 hours to be a sleeper, not off duty.

    Yeah, but I don't run split. Just ain't for me. I've never slept at the dock anyway, other than a cat nap.

    Actually that change came due to teams and forcing the co-driver to remain in the sleeper to be in an off duty location.

    There were many instances of the co-driver getting a log violation (no duty change when sitting up front) even for a small amount of time..like to have a cigarette, or to help the new student driving negotiate the scale crossing.

    New rule - riding in the shotgun seat of a CMV in operation can be called off-duty if it is immediately before or after a period of at least 8 hours in the sleeper. All other time in the shotgun seat of a CMV in operation is on-duty.
    395.2 new definition of on-duty time.

    You are not entirely correct, sir. As of February 2012, they definition of "On Duty" changed.

    On-duty time means all time from the time a driver begins to work or is required to be in readiness to work until the time the driver is relieved from work and all responsibility for performing work. On-duty time shall include:
    (1) All time at a plant, terminal, facility, or other property of a motor carrier or shipper, or on any public property, waiting to be dispatched, unless the driver has been relieved from duty by the motor carrier;
    (2) All time inspecting, servicing, or conditioning any commercial motor vehicle at any time;
    (3) All driving time as defined in the term driving time;
    (4) All time in or on a commercial motor vehicle, other than:
    (i) Time spent resting in or on a parked vehicle, except as otherwise provided in §397.5 of this subchapter;
    (ii) Time spent resting in a sleeper berth; or(iii) Up to 2 hours riding in the passenger seat of a property-carrying vehicle moving on the highway immediately before or after a period of at least 8 consecutive hours in the sleeper berth;

    My comments were limited to the issue of a CMV in operation, like I said in my post.

    Time spent in a parked CMV (not in operation) is also off-duty. Yes.

    Ok, we are on the same page. I only brought it up as your response appeared to be to kajidono's statement of off duty in the driver's seat.
