How Can I Legally Have A Firearm In My OTR Truck?

    I drive most all of the lower 48... I rarely travel north of New York. I want to know what steps I need to take to legality carry a handgun in my truck. If I got a license for it in my home state (Ga), is that going to be valid in other states? Please help... thanks.

    Not sure what you are saying when you say "...steps I need to take to 'legality' carry". Are you saying "...what steps you need to take to 'legally' carry?" If so, well, there are no such steps. At least that is what I have been told by numerous DOT officers, Virginia state troopers, and my buddy that is a Commonwealth Attorny of VA. I hold a concealed weapons permit in VA. It is good in VA, WVA, and TN. The reason you can't carry "legally" in a truck is because trucking is a federally regulated industry. Your permit is issued by the state. The federal government does not issue concealed weapons permits. They allow for a Class III weapon license, which I also hold (as a collector) but that is a completely different subject. In short, if you are carrying a firearm in your truck, you are committing a federal offense! Period!

    I used to think the same thing you state to be true...but i think you are incorrect on your statement.
    instate with a carry permit there is no regulation prohobiting him carrying with valid carry permit in his home state.Where thing start to get complicated is crossing state lines that may/may not reciprocate.
    I have seen(in print)this question presented to several DOT and state police officers and their responsw was..there is no law prohibiting..so i got a copy of the FMCSA and studied it..i also cannot find any such law...can you provide a link..or eveidence to your statement?










    I do not have a carry permit and do not carry in my Commercial vehicle,but im just stating that i think you are incorrect..(but who knows)

    A search of all the FMCSA regulations yields the following:
    - firearm(s), handgun(s), rifle(s): zero results
    - gun(s): one result
    There are NO FMCSA regulations concerning firearms.

    Title 18 Setcion 926(a). The peacable journey law.

    TITLE 18-CRIMES AND CRIMINAL PROCEDURE
    PART I-CRIMES
    CHAPTER 44-FIREARMS

    Sec. 926A. Interstate transportation of firearms
    Notwithstanding any other provision of any law or any rule or
    regulation of a State or any political subdivision thereof, any person
    who is not otherwise prohibited by this chapter from transporting,
    shipping, or receiving a firearm shall be entitled to transport a
    firearm for any lawful purpose from any place where he may lawfully
    possess and carry such firearm to any other place where he may lawfully
    possess and carry such firearm if, during such transportation the
    firearm is unloaded, and neither the firearm nor any ammunition being
    transported is readily accessible or is directly accessible from the
    passenger compartment of such transporting vehicle: Provided, That in
    the case of a vehicle without a compartment separate from the driver's
    compartment the firearm or ammunition shall be contained in a locked
    container other than the glove compartment or console.

    Now, if you could just provide me with the number of that Federal Regulation prohibiting firearms in CMV's, I would appreciate it.
    I need to know so I can fill out the citations properly.

    you need to follow the laws of every state you travel forget Ca Mass NY ILL

    the transport law does not cover if you have a destination in that state only passing through. just as imprtant most companys don't allow it for insurance liability reasons.

    I don't think that's anywhere near as important... if I have to use a gun to protect myself and the company wants to fire me because of it so be it... however if there were the possibility of me being held liable by another party, that could cause big problems...

    we really do need legal clarification on these matters from state and federal officials... but I'm not holding my breath...

    the point is you could be fired for posession long before a need for it arises. there are several threads covering this topic in detail do a search.
