I give up, ELD choked on the 3/7 split and now I don’t know what to do.

    Other than throw the ELD out the window and drive without logs.

    This is the second time I’ve been burned by the software and gotten a violation that (as far as the rules were explained to me.) I shouldn’t have. Also, the ELD is misleading because the clocks reset to make it appear I’m legal only to throw a violation after I go off duty.

    (for the record, this is a Rand)

    So fresh hours at 6:20 am, I spent the night at the receiver and they unload me while I eat breakfast. Log on at 7:15, hit the road at 7:30. 3 hrs and 45 minutes to the next shipper (with a quick coffee and bathroom break enroute) and pull in and go off duty (retroactively changed to SB in an attempt to “fix” the violation, but that didn’t work) customer loaded me from 11:20 to 4:45pm. All I gotta do is sign the bills and shut the doors, :15 minutes.

    Now here’s where it all goes wrong. My ELD clock says I can split my log and resets all the counters while I know I should be off at 9:15. But the logbook says I’m good if I take a 7 hour SB “later” so I drive until 11:30 pm. Find a spot in a rest area, go off duty, VIOLATION.

    Now my next issue, what can I even DO tomorrow? Do I only get :30 minutes to drive then go back on another 10 hour break?

    Or maybe I get the :30 minute balance of the day plus the 3:45 minutes from before? At least that’ll get me up to the next state and maybe somewhere I can get a shower.

    The 5:25 break while loading is shorter than 7 hours so it doesnt matter if it is sleeper berth or off duty. If you started with fresh clocks at 0715 and took a 5:25 break while beimg loaded you could drive for 7:15 hrs (11-3:45=7:15) or until 0240, which ever comes first. When you reach the point when you either want and/or have to stop go to slepper berth for 7 hrs. It may show a violation at first but after the 7 hrs has passed it should correct itself. After the 7 hrs is complete you can either drive for 3:45 + unused balance of 11, or stay in any off duty status (off duty, sleeper, pc) until 10 consecutive hours of off duty/sleeper/pc has passed to get full 11 and 14 back.

    I believe the problem you are having is that it initially shows a violation, but most systems I've seen or heard of correct the violation once the second half of the split berth is finished.

    It’s a lousy system.
    Presume guilt first.

    But the last time this happened it was on a Friday night and I went right into a 34. I went back and forth between customer service and fleet management, (and of course *I* had to be the middle man!) for the better part of a week.

    Ultimately it fell off my logbook, but my understanding is it’s still in the system for 6 months. No idea if it’s fixed or not. Probably not.

    (and I never had a problem with paper.)

    As long as the movement is legal and correctly logged, it doeant matter if the stupid ELD shows it as a violation or not. Legal is legal, requardless of what the stupid computer thinks.

    If you don’t have any way to make the computer aware that you plan to split then the computer doesn’t know that you’re splitting your sleeper until the second period has been completed, making your log legal.

    Not familiar with the Rand. But Qualcomm has a box you check. So it knows what you are doing. Perhaps that is what you are missing.

    I've heard mixed reviews on McNally electronics. As a general rule of thumb I try to stick with products that fall within the maker's area of expertise. Rand McNally is maps but not necessarily electronics. My Omnitracs hasn't goofed a split on me yet - but then again, I've never tried a split with the short part first either.

    Regardless, prior comments are correct in that the mere fact that your log device calls it a violation doesn't necessarily make it a violation. For example:

    One time I pulled into a truck stop and parked with like 10 seconds remaining on my 11. Before I could finish switching to sleeper, it chirped that I'd had a log violation. But when I finished switching to sleeper, it backtracked to when I shut the truck off, so it said I'd used 10:59 of my 11, but the log violation notice with the red exclamation mark on it was still active. I called compliance to try to clear things up and they just said not to worry - the logs themselves are what make violations, not the violation alert.
