If you have an Accident. Advice to new drivers.

    The pics from your phone ( all of them, ever taken) become evidence during the attorney's work under discovery; that is where the attorneys exchange all the evidence they have against each other. Do what you want, but I would never take pics of an accident i was in using my phone. I have an accident kit with a disposable camera. Also, demanding a warrant for a blood test is probably close to being a refusal. Again, you do what you want, but for me, I'm demanding a blood test pronto because I don't drink or party. Besides, it's DOT policy you pee in the cup after an accident, immediately if not sooner. Don't pee within 4 hours, it's a refusal. Refusal on your record, no more working for anyone that does a background check. You'd be better off with a positive test. At least you can argue that a little. Best advice, ask your attorney and your company's attorney ( yes, they have one you can talk to.:biggrin_2551:)

    Regarding the ability of police to search your cell phone, the Supreme Court has just handed down a ruling that the police need to have a search warrant before doing so:

    Therefore if the police want to see your phone, then you are within your rights to ask for a search warrant before providing the phone. Take pictures of the accident if you want IMHO.
