He’s missing the point entirely. He’s still trying to make the accident about the 2nd driver not carrying enough insurance(basically trying to change the subject matter)when the horse (and consequently it’s owner)was responsible from start to finish. Prior to the accident that horse was spotted on three different roads in that particular area. So it’s not the first time that horse was spotted off the owner’s property. That shows blatant disregard for the state’s rules and regulations, and the sheriffs department filed charges as they saw fit. If the owner’s wife ID’d the horse then that should tell you something
Maybe @buddyd157 has a thing for horses,I don’t know but I don’t feel sorry for the horse or it’s owner one bit. He didn’t keep his property locked up or secure, he’ll have to face the consequences.

what the others have just said, DOES HAPPEN. the dumbarse driver will not get to see any monies, for a long, long time..then as also mentions, the lawyers get a standard, about a third of any and all settlements.

what the horse did 3 DIFFERENT times ago is not a factor in THIS crash.
was the horse collared and taken away to jail or back to the owner? did the cops say anything regarding that..???
does the horse have any sort of violation records?

YOU could have been seen MANY TIMES peeing along the side of the road, were you ever arrested and charged with indecent exposure, should you go to trail cuz you did that yesterday?
they cannot bring that up about the past...WITHOUT proof.

annd i'll tell you another thing, once the skid marks, yaw marks and all other measurements are (or were) taken, if it is found to be, the dumbarse uninsured driver was going OVER the speed limit, don;t you think the lawyer for the farmer will bring that up..??
"Uh your honor, speed limit on that road was 30 MPH, and tests done BY THE POLICE, showed the driver was going 40 MPH".....
don;t you think..."case closed" will be gaveled by the judge? -

Here in Florida its even easier. Your primary residence(and all land attached to it if zoned agriculture) is immune. It can not be taken otr forced to be sold in judgements or bankruptcy. The only way to lose your house is by foreclosure and tax lien. The same applies to a vehicle. You get to keep one car or pickup if you can reasonably argue you need it to produce income such as drive to work or in the case of a guy with livestock you need your pickup to get grain and hay.
