How could it be public intoxication if the dude is in his house?

If he comes outside of the house into a public area (I.e.,off his property).

I'm a visual person. Here is a Google view of the place, with notes by me. There's room to turn around on either side of the road before you get to that bridge.

Now my question is, are you guys saying that if I get in a wreck, I should immediately start drinking before the cops show up?

A driver hit a guardrail head on east of Denver on I70 several years ago. Inatentive driving caused (on cell texting) the CSP found him sitting at a bar several miles from the crash site drinking a beer. They couldn't charge him with anything.

If you come outside like they ask, you are in public.

It matters not. Company issues information on the driver sufficient to track him down.

I notice the bridge was 11.8

I don't understand what the attraction is with a measly 11.8 bridge built by engineers too stupid to make it a full ride at 13.6.

That picture makes me wonder if driver saw sign but figured he made it under the first bridge so the second should be the same ... either way he messed up big

    No you are not, X.
As long as you are on your property, you're on Private Property.

Ok. Let's talk. (Other than argue.)

See here. If I owned a house on several acres, Police on my land my curtiledge as guests.

Now in housing or rental property, anything outside your front door is common public property, inside or out.

He did not leave the scene, The accident was at or very near the store. As far as what a cop can charge and what they will throw out in court is two entirely different things. Cops are typically looking for a reason to lock you up, If he does not catch you inside the vehicle it probably wont stick, maybe drinking in public, but thats alot better than DUI. And cops lie as a routine part of their job.
