Oh, well nothing like inconsistently applied company policy; the treatment of drivers at the same company can be astoundingly different, as well.

First you didnt answer if you were a 1099 contractor or an employee.

Second there is no safe haven use of PC.

Third my point is protect your CDL, this sounds like a POS carrier who will charge you back when you get caught and there is a nice fine.

That's a company thing because it's exactly what PC is for. Ask them what exactly are you supposed to do when out of hours and the receiver says GTFO of here?

He's being a ying-yang about your use of the term "safe haven." That technically has ONLY to do with haz-mat drivers. A safe haven is a safe place to park that is compliant with the haz mat regulations regarding distances from all sorts of stuff. "Safe haven" is not "a safe place to park." They are actually 2 different things when it comes to the DOT. He is technically right, there is no PC allowance for safe havens for hazmatters.

"The FMCSA's "Safe Haven" and "Adverse Conditions" regulations are worded to address two separate types of situations. The Safe Haven rule applies to acceptable parking locations for Hazmat drivers. The Adverse Conditions rule applies to unexpected and unavoidable delays that cause a driver to run out of driving hours."

I tried to post the link I got that from, but the forum software here says it comes back as spam or something. I can't do it. I tried.

Heaven forbid one of your drivers is involved in a fatality accident while on one of these PC ventures. Between the FMCSA, your state DOT, and the victims lawyers, the company, it's owners and all of the driver's who have used PC wrong will all be banned from trucking if not prison.

You can use PC if you run out of HOS at pickup or delivery to first safe place to park. If you have driving time available you can’t use PC. Unless you can’t make safe place to park. If you have 30 minutes left and it 35 miles to truck stop or something I would probably just use PC

My company dispatchers got in a little trouble because they were sending drivers to deliver knowing the driver would be out of hours when we got there. Then telling drive to use PC to leave when unloaded, They can’t knowingly send driver to delivery out of HOS. Then also say use PC when empty to leave.

That's actually what are company tells us to do as well. Very rare do I get caught in that situation. We are only allotted 30 minutes daily to PC. Basically, it really don't even make sense to use it except on a 34. I've used it occasionally on a 10, but only if the police or the staff at a customer made me move. You ain't supposed to use PC to advance a load, I'd I understand it correctly.

Start logging on duty at the shipper/receiver like the regulations say you should, then you will get your ten hour break after you PC to a resting place.

Better yet, find another job so you don't have to work for a bunch of outlaws
