My company lied on Dac Report

    I was told I have four items on my Dac Report and when I called to discuss the issues they told me that they were not talking them off and that since they are now a federal document that my company can't remove them from the Report. In the meantime I can't get another driving job because of this. I challenged the Report but they refused to change anything ,so I've appealed their decision and I'm waiting on a response. What's my next step in this process ?

    You APPEAL through The HIRERIGHT SYSTEM.
    It's no longer DAC. It has not been Dac for some YEARS. Please update.

    I challenged one company that claimed I was their employee when in FACT I was working through a Temp To Perm Truck DRIVER Service.
    HIRERIGHT challenged the company and the Company backed down and erased the faulty report, before it would certainly have gotten into LEGAL mess.

    YOU HAVE THE RIGHT TO CHALLENGE ANY COMPANY INFORMATION REGARDING YOUR SAFTEY/EMPLOYMENT RECORD,
    AS LONG AS YOU HAVE UNQUESTIONABLE FACTUAL VERIFICATION/VALIDATION.

    It is not a federal document, it is a third party report that is regulated by fair credit reporting laws.

    Any company says this shows how ignorant the people are at that company.

    Fight it through hireright. This happened to me after i called the Safety guy wisker bisquit. (not good idea) i took me couple months to find out he put BS on my dac. Another 6 weeks to get it off.

    First, what exactly are you saying they put on your report that is false? I am not asking for specifics really, more generalization. Saying you had an accident? Saying you quit without notice? Saying you failed a drug test? If any of these are true with the exception of not giving notice, then you may have to provide some sort of proof yourself you weren't at fault, or did not fail a drug test. A consumer credit report (which is what a hireright report is, is NOT a federal document.

    IF the CRA (in this case Hireright) has incorrect information on your report, as was the case in my situation, yes, you could sue. But only if they fail to mitigate the damages. Hireright was putting on reports supplied to requestor's another persons driver license history which had a DWI, and some other charges on it as well, in a state I never have resided or held a license in. The issue comes when you make this known to them, and they refuse to correct the information. In my case the only suitable correction, was that they remove the erroneous information from my reports and then resubmit those corrected to reports to the requestor's who received the invalid or incorrect information within a period of time most recent to correction. If they correct the errors, then they have mitigated the damages, therefore you'd have no damages. Unless you could prove it actually did cause you actual damage, i.e. made far less money because you lost an opportunity you can quantifiably prove you would have made more on. In my example, if they simply said piss on you we aren't removing this other persons name and information from your report, then you'd have every right to sue them and collect statutory damages and any actual damages in the process. In my case, the guys name wasn't even the same as mine, last name was but first name, license number, height, weight, and social were all different from mine.

    You are entitled to AT LEAST one free DAC / Hire Right report every year. You should get your won report and read it instead of taking your company's word for what is on your report. You ask Hire Right to verify the incorrect information. You also have the right to add a BRIEF statement that must be given to anyone making an inquiry about your Hire Right report. Go to North America | Candidate Help Center there are links for help with your situation IF YOU FOLLOW THE RULES. Telling us or your former employer you disagree with what is on our report is not going to change anything.

    You can sue them for having an impure thought on a steamboat landing if you have the money or time to file the paperwork.
