i want to keep company name anonymous(ill call it "my company" below) because it's not a bash against them, but more so the practices. and i wanted to hear your opinions on it. if the facts i am mention below is true, then did my company do blunder on how they handled the situation? is my proposed solutions a good path forward? how likely am i to get fired after confronting my company about the proposed solutions? anything i mentioned do you disagree with on proposed solutions?
back story,
im in probation period first 90 days with employer.
i am in good standing. no accidents. attendance perfect. always ontime delivery.
during that 90 days my codriver got into 2 accidents(2nd accident was near the end of the 90 days probation), these were minor accidents where pulling out of a tight spot trailer swing connected with trailer next to it in parking lot. in first accident was some torn seals on the door. 2nd accident was just minor scratches but still technically an accident of 2 trailers making contact. so in both scenarios i took picture of accident as it happened. and told partner we are suppost to report accidents even if small just to be safe because company didn't ascertain how severe the accident needs to be, so we should call it in to be safe.
the result of this was codriver retaliated against me, didnt want to team with me anymore.
then company doesn't do reasonable accomodation to assign drivers new codriver if asked. so when my codriver asked for another codriver, the company relatiated against me for it, and failed my probationary period off of defamatory remarks against me.
most trucking companies provide reasonable accomodation to drivers who ask for another codriver without doing any adverse employment actions.which is how it's suppost to be done to create a safe workplace for teams trucking jobs. my company does opposite and does adverse employment actions if codrivers ask to seperate.
my personal verdict:
1. my company in my opinion is guilty of retaliation for me to speak up against unsafe work conditions,
2. coersion for me to not report accidents,
3. and guilty of not providing safe workplace of reasonable accomodation for drivers who ask for another codriver.
4. they are also guilty of defamation as i didn't do anything reasonable to justify me failing probationary period.
proposed solution:
1. the proposed solution is to appeal or remove the adverse employment action done against me. the stuff i experienced easily qualifies as retaliation for speaking up about work place safety conditions, coersion to not report accidents, and also defamatory adverse employment action done against me. there is laws and/or regulations against each of these things as part of employer's responsibilities.
2. my company, i feel needs to modify how they assign driver's codrivers to match how most companies do it. there needs to be more flexibility from my company on assigning drivers codrivers. should be random and if driver's ask to be together longer term then the company can do that, but there should be no asking drivings to stay together and forcing it and doing adverse write ups if the workers want seperation or another codriver.
the result would be safer work place for teams drivers. failure to accomodate drivers this way is a workplace hazard for workers.

My key takeaway from this?
You need to really examine if fighting this battle to get the company to change it's corrupt ways is worth it...
You said so yourself that most companies provide reasonable accomodation for conflict of interest issues between co-drivers.
I say move on to one of those companies. It's going to take a lot less energy than going to bat on a matter of principle.Ddh77777, OldeSkool, firemedic2816 and 2 others Thank this. -
Are you still at Company X? Did they get another co driver?
Also, "my most recent company" tells me there have been incidents at other companies. "Care to elaborate?"Ddh77777, Trucker61016, firemedic2816 and 3 others Thank this. -
I think you're a tattletale. I don't think you had any business going out there and taking pics when you didn't cause the incident. I don't care what the policy is. Your partner covered his behind by requesting a change in co-drivers first.....he made you look like crap so he could get his way and keep his job. What do you think you'll gain by appealing? My curiosity looms..........

I’m guessing they want to file a lawsuit instead of continuing to be employed there. At least that was my takeaway from it.snowlauncher, Lonesome and Voodoo Pyg Thank this.

Unfortunately, you're probably right. We live in a society where everyone wants reconciliation, or reparations when things don't come out right for them. If you feel like you've been given a bad rap by a trucking company you have 2 choices; pull up your big boy pants and stick it out, or move on. No sense trying to be a catalyst for the company to change their ways. It won't end well for you.Lonesome and firemedic2816 Thank this.

I think the original poster should start his own trucking company. Using all his talents and money and time to build up the business. Then, when it's a very large, successful business, make sure you take the advice of an inexperienced, new employee's thoughts on how to run the business.

I'm not sure why you'd even report bumping a trailer it happens but unless it was damaged severely just chalk it up to learning to get out and look......if you didn't take out the hood of a Peterbilt then you're good to roll....bryan21384 Thanks this.

why team with company appointees or at all??
Lonesome Thanks this. -
What about the trailers that he "bumped"? Just a few scratches may be ok for his trailer but it sure wouldn't be if he hit my trailer.OldeSkool, TB John, Lonesome and 1 other person Thank this.
