No charges for judge who hit and killed pedestrian

    Criminal charges will not be filed in the fatal case of a pedestrian hit by two drivers, including a Hamilton County judge, late last year, Cincinnati traffic police said Friday.

    That's because toxicology tests show the pedestrian, Pamela Barnett, 60, had high levels of cocaine in her system and was not in the crosswalk when she went out in the 2100 block of Central Parkway in the West End and then stood on a center line during evening rush hour traffic, police said.

    The City of Cincinnati Prosecutor's Office reviewed the case and ruled there would be no charges filed against the motorists who struck her, Hamilton County Appeals Court Judge Patrick Dinkelacker, 59, and Grace Ring, 32.

    Barnett went into the busy road just before 6 p.m. on Dec. 10. She began crossing from west to east and then stopped on the center line, police wrote in a prepared statement.

    Dinkelacker was driving his 2013 Cadillac SRX south on Central Parkway when he struck the woman, who was knocked onto the northbound lanes of Central Parkway.

    She was hit again, this time by a 2011 Toyota Camry heading north on Central Parkway.

    Barnett died at the scene.

    The judge and Ring, the driver of the Toyota, wore their seat belts and were not hurt.

    Dinkelacker was so distraught, he cried at the scene.

    "Ms. Barnett had entered the roadway during rush hour at night, not in a crosswalk," police wrote. "Toxicology results received from the Hamilton County Coroner revealed that Ms. Barnett had a very high level of cocaine and cocaine metabolites in her system, consistent with recent use and impairment."

    The case is now closed.

    Great news! Motorists have no responsibility to maintain their lane/stay off the double-yellow centerline.

    While I get what you are saying, it's just as likely that she wasn't literally on the centerline, could of been over it by a foot. Neither of us was there, and without video of the moment in question none of us know what really happened.

    Not every bad thing that happens needs to result in someone getting punished by the government. Sometimes the punishment is dealt out on the spot, like in this case. She looks to be mostly at fault, and she got the most punishment, the judge didn't go unpunished. Kind of like when a toddler drowns in the tub or pool, the parents who made the mistake of not supervising close enough are punished through the loss of their child and the knowledge that they probably should have done a better job. No need for a government trial to pile on the situation.

    But granted - need to slow down a bit and be careful too - there's crazies out there!

    Here we go again with political people getting away with #### because of said affiliation. Whether she had cocaine in her system or not or whether she was not in the cross walk, it is a drivers duty to be wary of pedestrians. I’m not saying he should be charged with murder, but at least vehicular manslaughter. HE was in control of the car that hit the lady and he should of be held responsible, no if ands or buts.

    I hate crosswalks at intersections. Everyone is more focused at something else. Other vehicles, staring at the light just waiting for it to turn, cell phones, bowls of cereal, changing the radio station, looking at that woman with the long legs....

    People are more likely to see you crossing in the middle of a block as there are less distractions.

    When you cross the street at an intersection you always have to worry bout the people making a right turn because they need to be looking left away from you...

    Judge needs to get a dash cam is all I can say.
