Open Container Policy

    Just a guess, the driver was handed multiple tickets, which she signed for, one was intended for you. She showed in court, and you didn't, automatic guilty plea submitted in your absence.

    Seriously you need to look into this, if you have an unpaid fine sitting at the courthouse, you maybe looking at a bench warrant, and possible license suspension very soon!

    I agree when you're driving the vehicle from the passenger seat how can that be a moving violation?

    For reals though I don't see how it could be a moving violation if you were riding in the passenger seat. You've let it go for about 6 months and are just finding out about this?

    Note to self, it is cheaper to litter than take a open container ticket.

    I am going to guess they were terminated when the company found it on their MVR, hence the post and looking for a company that will hire with an open container.

    Years ago I was a passenger with an open beer.
    Il. State police pulled us over, driver got no citations and the trooper asked If I wanted to appear in court for open alcohol or settle it here, can't remember how much money went into his pocket

    There is no law that says you can't have alcohol in your system while driving. So what's the problem with an empty container

    My point is why did the officer stop this car in the first place.He sees an open container smells it on the person it doesn t take a rocket scientist to figure it out.If op feels this was unjustified then take it to court.

    Lol, for the third time I was a passenger. The empty six pack was from a party in the woods. The officer pulled the driver over for a stop sign violation. Noticed the six pack and proceeded to ask questions I told him the six pack was from a party and we didn't wanna litter. He said I have to give you an open container. I said ok, I went and pled guilty. Paid my fine and now I'm looking for a new job and this keeps popping up and disqualifying me from employment. What I don't understand is why would this be on my mvr when I was just a passenger. I need to know is there any employers that would take me I'm willing to do otr or regional.

    This is just a guess, but maybe it is on your NVR because it's a violation of the Motor Vehicle Code as opposed to a Criminal offense, so it was sent to DMV.

    You might give Continental Express a call. They are out of Sidney OH and do a lot of runs to Allentown. Regional reefer outfit. Pay starts at $.45 a mile if I remember right, plus $.03 in bonus.

    It's kind of a crap company, but they are always hiring drivers because they can't retain them, and their standards aren't that high. I lasted 90 days.
