having it in the truck while driving is; "transporting alcoholic bev without a permit". got that from a DOT guy.having in cab while parked is not illegal.

It's actually a little more specific than that. The wording is "On duty or operating a cmv" while in possession.
If you are parked on duty you cannot have it in the truck. Same as if you are off duty driving (pc) you can have a beer in the cab.Bean Jr. Thanks this. -

The DOT is not a serious threat to a driver that uses alcohol in a responsible manner! A driver is in much more danger of having another driver narcing them out with their safety dept. Everybody has a camera today. If you drive for a large carrier and don't think another driver won't drop a dime on you, well your being a bit of a fool!
