I was offered a position as a truck driver with a great "fixed" salary which included meals and expenses while over the road. If the occasion arose that my load was not ready I would just fill in as necessary in the shop till it was ready... I was told by an attorney that Federal regulations prohibited a company from paying a truck driver a salary... Has anyone ever hear of such a law or provision?

I worked for a local trucking company where we were local only, but instead of an hourly pay or a percentage of loads, he payed by the month and you worked 10 to 11 hours a day or longer which was good for the owner because he got work done for free after the employees 8 hours were done. I only took that for so long i dont work for free for anyone.

There are a lot of private fleet companies that pay on a salary basis, but with adjustments for non-standard route loads.

There are several heavy haul compaines that pay salary.
Better find a better att.
Just asking why do you need an att.?
You have your employer draw up a contract and you read it.
If you and the employer agree on the terms and wording you sign your sig. on it and they sign.
Keep a copy for your records..
How hard is that -
I've been on salary before and I'm on salary now. I love it! my check is the same every 2 weeks and if I happen to work more, I get paid more! I dont think it's illegal at all, I sure hope not!

just because you sign a contract agreeing to something, that doesn't make it legal. a lot of these companies classifying company drivers as "independent contractors" are finding that out the expensive way. you can take your attorney's advice, or you can take advice from a trucking website message board lawyer who has a PhD in blind side backing.
