Potential employer asking for 36 years of medical history?

    I authorize a physician, medical practitioner, hospital, clinic or other health facility or employer to release any and all medical and non-medical information in its possession about me to this employer, or its legal representative. Medical information means all information in the possession or derived from providers of health care regarding the medical history, mental or physical condition or treatment of me. I know that I may request and receive a copy of this authorization. I agree that a photocopy of this authorization shall be valid as the original. I agree that this authorization shall be valid as long as I am employed.

    This sounds like this company is asking for the keys to the kingdom sort of speak. They offer an explanation on what they mean by medical, but not the non medical. They don't say exactly what they are after. Just that they want complete access to anything medical and non medical. After i supplied my Medical card and dot long form from the physical I just had done a couple months ago renewing my 2 year med cert.

    The company i left had improperly stored some of my medical info. After a security breach offered a measly 1 year subscription to a subpar identity theft service.

    I understand some drivers are not in the best of shape. I'm on the other end of that spectrum. I would think that long form would provide all the info they need for job related function. If they want me to get another physical, fine.

    Apparently this is a post job offer conditional upon: me signing.

    If I have to sign over my entire medical history in order to obtain this job. I don't need it that bad.

    No there's nothing in my medical history worth hiding. It's more of a point, this doesn't seem right. My question, is this normal now?

    no it is not normal, and the employer has no duty to keep anything private.

    All I need to know is if you have a valid medical clearance.

    They cannot access your medical info, beyond a dot physical, without your authorization. HIPPA protects your privacy. I had who I thought was a safety pogue ask me all kinds of medical crap. She ended up being from their insurance provider. I cut her off. There is no legal reason for them to ask you for your records.

    Sounds like to me they want future medical records if you go to their doctors. If you get hurt on the job and need medical leave or sleep apnea results or compliance if they provide that to drivers. I don’t think you can sign anything that will give them access to your past medical history. HIPPA will stop them. You would have sign papers at every doctor you go to for them to release your medical records. It would be to easy to just make up a medical release for and sign you name. No doctor’s office would except that. You would have sign papers for them to release your records.

    That’s different. I can read a criminal history, but medical history, I can not, I am not a doctor.

    A criminal history is clear, I do not have to be trained in how to read it and interpret it.

    Medical records I can read but interpreting it requires a medical education in the form of a doctor or nurse.

    I only need to know whether the driver is legally able to drive under the FMCSA regulations or not.

    I also know anything that is given to me is not protected by any law, my obligation to do so is waived if like in the case of the op, signed that right away or sent me medical records.

    Now if I went to his provider and fraudulently got his records, that’s on both of us - the provider and me.

    HIPAA does not protect anyone if it is used for a dot physical, meaning that the examiner and only the examiner has to duty to examine the records that have to do with passing a physical. On the other hand it is only … ONLY for providers, it does not apply to a carrier.

    I would never sign anything like that and wouldn't work for a company that expects me to.

    What about when driver get Random drug test. They have be able to share the results with your carrier and we have the drug clearing house thing the government runs now. A new job also includes they have check that government website to see if a driver has every tested positive for drugs or if driver refuses to take test.

    my company had use do several things to get that ok so they could run use thru the database from what remember.

    If you want to work for a company & be covered by their liability insurance you can comply or go start your own trucking company. The company gets sued when you screw up. They will not just accept your assurance you are healthy. Life is not a hypothetical situation. There are other jobs besides trucking.

    Right maybe you could read the rest of what i posted. There's always one of you.

    I've been with 2 companies in the past 10 years.

    I've provided every thing this potential employer has asked for, clearing house, pre drug screen. Credit check, back ground check, dot long form etc

    My question: is providing the entirety of my medical history now required to operate a cmv. Is EVERY company requiring this?
