PSP report

    Recently got pulled over in California for a lane violation. Received a ticket and he asked me to tighten a strap.

    month later I check my psp report and it says my lane violation of course but says he did a level 3 inspection and I got an oos violation for leaking, blowing , spilling, falling cargo. Which none of that was happening. He never checked my logs etc and also never gave me an inspection report. All I received was a ticket for the lane violation. Is there anyway to fight this considering he never gave me an inspection report for his “level 3 inspection”?

    I15 in murrieta. I was in the 3rd lane of 4 lanes because the right 2 weren’t moving. There’s no signs posted for lane restriction but I guess it’s a state wide cali thing I didn’t know about.

    California is strict with lanes, many don’t know even with 3 lanes, you need to stay on the right and use the middle to pass ONLY and return to the right lane. Some counties are stricter than others. Regarding the loose strap, your lucky he didn’t right you up for unsafe load, that runs around $800.00. Now about your PSP, I couldn’t comment on that.

    Safety Measurement System once it is over 30 days old, check this website with your companies DOT and look for your inspection AND print it if it is there.

    Then go beck into the FCMSA web and file a 'Data Q' reporting the lack of a report at the time of the 'inspection'....

    This goes back to the officer 'through his supervisor' to be checked out.

    You may get lucky.

    You need the inspection number, etc. from the SMS report to file the Data Q and make sure you mention not being placed 'Out of Service' on the spot like you should have been.

    Yep, right lane only unless there’s signage saying “Trucks this lane OK”.

    I learned early on and got lucky. CHP Was on a motorcycle and he lit me up until I moved to the right and he kept on going. Free education :)

    ok so do I select the reason as lost/didn’t receive inspection report?

    NO.

    ''Cited for incorrect lane usage; no inspection report tendered and not placed 'out of service' on the scene as required by the FCMSA." and go on to mention how you were directed to adjust the load securement and released without receiving any inspection report, just the wrong lane citation.

    At least make the officer explain his actions to his superior but no guarantee of it being dismissed but it is the only way to try and get it updated.

    If successful it still takes waiting until the next cycle of the monthly SMS report to have the carrier's record{s} corrected and that should get the PSP to change too.
