Question regarding DOT Hours of Service Exemption

    Does anybody know any details about the Hours of Service Exemption for "utility service vehicles" ??
    *Public Law 109-59-Aug. 10, 2005

    We are a utility construction company that work for Charter, Century-Link, Xcel Energy and others......does this exemption apply to us as well??

    As a rule we do not make a habit of that.

    The work cycle needs to be normal for the day and got disrupted. For example if you had 300 miles to drive today to get to a customer and got stuck 9 hours due to a multipule fatal crash then exemption. We usually park at the next truckstop and go get dinner and sleep. Start over tomorrow. Worry about appt delivery reschedule if need be.

    As a rule we stop when the logs stay to stop. Meaning when the 11 hours is up, you are parked. No free exemption and likewise with the 14 hour clock, When you burn that up. You quit for the day and get your rest. No exemption.

    You DO NOT want to be using that or trying to claim exemption because you have 1000 miles to drive today due to overwork or too many business customers calling you for service etc. All of them will just have to wait until you get there. But not before.

    We only used that rule like two times in my lifetime. And thats only because of fatals which otherwise made a normal workday very long.
