    What a joke. I don't understand how it's the equipment's fault the guy's foot was ran over. Even if it were held together with bubblegum it doesn't make sense.

    I actually took the time to hunt down and read the transcript from that suit.
    It wasn't as ridiculous as the media made it out to be.

    I think I need to get in contact with this guys attorney, I caught a faulty load bar in the head and it left a scar that must be worth a million dollars.

    I didn't read the transcript ... but let me guess the tandem release handle was bent/damaged - ie not maintained. Nimrod didn't have the foresight or knowledge to use channel locks ... so he gets under the trailer and holds the handle ... while his partner in crime - the aforementioned improperly trained driver - rolls out, not setting the trailer brake and takes out nimrods foot.

    Swift gets hung for the bent release handle and the untrained driver.

    This why when ever I have a stubborn tandem and a good samaritan offers to hold the handle, I say thanks, but no thanks. No one is going to be knowingly under any trailer I'm pulling, if the tractor is going to be in gear.
