I am trying to catch up on my last year taxes, I drove 1 month for this guy, it didn't work out, I got paid from 12/5 to January 11, so I should had gotten two 1099 from him, but I got none. He was unhappy that I didn't stick around, he won't answer my phone calls, how do I know if you reported anything, if he did, how can I track down the 1099 form ?

For those of us that are working for small companies, the guy I work for now only has 5 trucks, all I do is drive for him, he does the dispatching, he pays for all repairs, he gives me a credit card with my name on it so that I can pay for fuel, tire repairs, road service, etc...
So am I an employee or am I an independent contractor ?
Should I had gotten a W2 or the 1099 that I got this year ?

If I run 100 loads a year for 100 different brokerages I MIGHT MIGHT get 5 1099's.
LOL. I don't know why. I use my own records so I don't care....but I am not sure why.
Did you make over $600.00? I am sure you did but if not then he does not have to provide one.
And I think I read something about paperless being a thing.....like they don't have to send them anymore. Not sure on that one though. -

To the op, you are an employee when you have no contract with the company you are working for and that also means you can refuse the work unless it is a contractual obligation to serve one or a few customers.
As for your missing 1099, you are required to account for it by documenting the details of it, so it is simple, make a note for it in your tax records and how you derived at the amount.

When you work as a company driver, driving a company truck, and you get screwed it is your fault. You and the company owner are both in violation of the law. Maybe you got what you deserve.
