Taxes and missing 1099

    I am trying to catch up on my last year taxes, I drove 1 month for this guy, it didn't work out, I got paid from 12/5 to January 11, so I should had gotten two 1099 from him, but I got none. He was unhappy that I didn't stick around, he won't answer my phone calls, how do I know if you reported anything, if he did, how can I track down the 1099 form ?

    Trying to research this matter I ran into this article...

    For those of us that are working for small companies, the guy I work for now only has 5 trucks, all I do is drive for him, he does the dispatching, he pays for all repairs, he gives me a credit card with my name on it so that I can pay for fuel, tire repairs, road service, etc...

    So am I an employee or am I an independent contractor ?
    Should I had gotten a W2 or the 1099 that I got this year ?

    Just report the income you got it from him. If later that 1099 shows up, you have your butt covered

    If I run 100 loads a year for 100 different brokerages I MIGHT MIGHT get 5 1099's.

    LOL. I don't know why. I use my own records so I don't care....but I am not sure why.

    Did you make over $600.00? I am sure you did but if not then he does not have to provide one.

    And I think I read something about paperless being a thing.....like they don't have to send them anymore. Not sure on that one though.

    Because 1099's are not required in transportation.

    To the op, you are an employee when you have no contract with the company you are working for and that also means you can refuse the work unless it is a contractual obligation to serve one or a few customers.

    As for your missing 1099, you are required to account for it by documenting the details of it, so it is simple, make a note for it in your tax records and how you derived at the amount.

    This isn't as simple as you make it out to be, it is better to receive a 1099 than to go through an audit and have to prove the accuracy of your income, the IRS always lands on the side on a higher number when they issue a fine.

    That fact remains that you don't have to issue a 1099 in transportation. Have never issued any in 20+ years on the brokerage side and have went through two audits with no problems.
    If the person that doesn't receive one has sloppy accounting then that has nothing to do whether they got one or not.

    When you work as a company driver, driving a company truck, and you get screwed it is your fault. You and the company owner are both in violation of the law. Maybe you got what you deserve.
