Back in my aviation days we had a "12 hour bottle to throttle" rule (unwritten). Meaning you don't get in the ####pit within 12 hours of your last drink. Needless to say, there's a reason most FO's fly the plane.

I like the way German Poilzei do it. As we all know a lot of drinking goes on in Germany...yes they have the best beer! they dont even have an open container law. The catch there is the Polizei dont need probable cause to pull you over. They can just pull you over for no reason at all and test you on the breathalyzer. This is a big deterrent to keep people from drinking and driving there knowing that if you do it you can be randomly pulled over.
This is.kind of beside the point in this discussion here but it is interesting to see how this problem is dealt with in another country. Whether you have an occasional drink in your truck well that is up to you. Just dont move that truck if you do!! Enjoy that drank at home...

"3) Be on duty or operate a commercial motor vehicle while the driver possesses wine of not less than one-half of one per centum of alcohol by volume, beer as defined in 26 U.S.C. 5052(a), of the Internal Revenue Code of 1954, or distilled spirits as defined in section 5002(a)(8), of such Code." The operative word being "operate." I don't see how this prohibits you from drinking a beer in your truck, during a 34 hour reset. By definition, you are off duty and not operating your truck. Driving with it in your truck, or under the influence, is obviously a different matter.
