    “I can tell you this vehicle will not be cited because it was two feet from the fog line which is the adequate amount of feet away from the roadway,” Sgt. Robin Green told the outlet. So the truck driver was on the shoulder when he struck the abandoned vehicle.

    If the roles were reversed, and a car struck an abandoned tractor trailer in the same position, what would be the outcome then?

    Someone who knows more than me, how about chiming in. I always have been under the impression that the law states that when a vehicle is parked on the Interstate, you have two hours to move it or it will be towed. I know that if this a law, it isn't enforced because the route I run, I see the same vehicles sitting on the shoulder day after day and some week after week.

    The practice of parking on the shoulder of an Interstate has become so common that I suspect that we will see picnic tables placed there for the convenience of those who want to pull over and have lunch.

    What really irks the hell out of me, for a driver to go right by a ramp and then pull off on a narrow shoulder.

    Universal Citation: LA Rev Stat § 32:296
    §296. Stopping, parking, or standing upon the highway shoulder; driving upon the highway shoulder

    A. No person shall stop, park, or leave standing any unattended vehicle on any state highway shoulder, unless such stopping, parking, or standing is made necessary by an emergency, except:

    (1) In those areas designated as parking areas by the Department of Transportation and Development, or

    (2) By any public utility personnel or public utility equipment engaged in the operation of the utility business, public vehicles owned by public bodies which are engaged in the conduct of official business, or privately owned vehicles which are engaged in services authorized by the local governing authority.

    (3) Persons riding bicycles shall be allowed to operate on the shoulder of a roadway.

    B. In case of an emergency, the driver of a vehicle may lawfully operate the vehicle on any state highway shoulder in accordance with the normal standards of prudent conduct to protect himself and others from harm. When the emergency ends, the vehicle shall not be operated on the state highway shoulder.

    C. If the vehicle is not removed from the highway within twenty-four hours, the provisions of R.S. 32:473.1(B) shall apply.

    Lol, so the truck struck a car and that car hasn’t moved upon impact so they know it was 2 feet from the fog line.

    Or, you know, the professionals actually did an investigation. Stuff as simple as tire marks can easily prove where the car was when hit.

    A word to the wise, going north on 1-81 after crossing Buffalo Creek around mm 183, starting up the hill where there are three lanes, you have a wide shoulder and trucks have a habit of pulling off and stopping there. The state and county are watching this and enforcing "no stopping or parking". The "bear" is sitting in the crossover at the bottom of the hill just after you cross Buffalo Creek.
