What are you trying to uncover, it wasn’t a hit and run situation. The truck driver stopped and remained on scene.

Unfortunately, this happens almost on a daily basis. People just don’t realize the danger of standing on the side of the road. Unless injured and couldn’t be moved always get yourself away from where you can be hit.

Condolences to the family but sounds like lawsuit stuff.

 

Did the article mention if the accident that led to them being on the side of the highway had been resolved?

Obviously money and a lawsuit is why they're asking, maybe to put blame on the at fault person for the previous wreck?

What I would want to know..
Was the area well lit?
Did the truck involved have a dash camera? There’s ways to find out if he did and removed it post accident..
Was the truck speeding? There’s ways to find out his exact speed if Law enforcement impounded the truck.
What are the details of the “move over law”..not all states are the same. GA for example includes any vehicle on the shoulder with its flashers on. You’re required to move over or slow to 20mph? under.
Did the deceased driver have their flashers on?
Does the city have any images from cameras?

A friend of mine ran over a drunk pedestrian in NYC and didn’t realize it until LE contacted him days later. They had images of his truck and the entire route he took.

I’m no lawyer that’s for sure but I imagine the first minor accident is irrelevant.
Maybe there wasn’t a second vehicle involved..the op and article didn’t say.

I see the idiots that refuse to move over all the time even when they have no traffic around them. Just as I see the idiots outside their vehicles on the shoulder with their backs to oncoming traffic.
