What legal actions can we take if a shipper doesn't pay out?

    We have a shipper who hasn't paid out his invoice in over two months, his contract states he has 15 days to pay the invoice with no setbacks or delays and he has not sent in any payment. We want to file some legal action against him but his contract says we can not take legal action until 6 months. What can we do at this point to get our payment from him?

    You can write them a nice letter with the invoice enclosed, reminding them that the payment is overdue and if the payment isn't made in a reasonable amount of time, interest will start accruing and you may seek legal action to recover the monies owed.

    Does it mean that that can screw you around for 6 months with impunity? I find it hard to accept that there could be a lawful contract stipulation at all that could prevent a legal action to be taken against somebody - especially for nonpaying. Even if there is anything stated like that, it may be superseded by an actual law. I hope.

    6 months before legal action. He's played this game before. Cut him off when they reach their credit line. Keep sending reminders of past due.
