I wonder in a situation like this if the driver gets charged with an accident or a preventable on his record?

I "almost" had a high profile load I was pulling one night get away from me, it was on hwy 50 in MD the bay bridge going east across the bay, that bridge takes a turn about 1/4 the way out and when I made that corner what was a headwind had me hanging on for dear life, they shut it down for high winds right after I crossed, change of undies was needed.
