When arguing over a McDonald’s fillet of fish lands you a trip to jail

    That was not what I heard. What I heard was the cop getting between the woman and the manager. Got her problem resolved, then asked for ID. I never once heard the word trespass. Oh, by the way, trespass is a two-step process. If that manager had asked her to leave the business, then the woman would have been required to leave. If she came back or refused to leave, NOW she has committed a crime and the cop can legally demand ID.

    Now I admit I am NOT an Attorney. I have, however, spoken to my Attorney on this subject many times. His answers are very close to what THIS Attorney said about IDs.



    On the subject of trespass. I know this is an Alabama case, but carefully watching this video of ANOTHER ATTORNEY explaining FEDERAL caselaw about this process should put that to bed.




    One last thing. I hate what that woman did in this video. It's a dang chicken sandwich for gosh sakes, not the crown jewels. These days, almost all of the chain restaurants have websites where you can go to make a complaint. I have complained about KFC several times, and they fixed the issue. In the end, although I believe the cop was wrong, the woman should have complied, then filed a complaint later. Even though the cop was wrong, bringing down what was in effect a temper tantrum in a public place like that is just childish.

    as someone who has been involved in a trespass after an altercation in a bar i need to tell you that you are wrong.

    She does need a smack upside her head for creating a scene though.

    As someone who has worked at a McDonald’s (2 corporate,2 owner operated,as a cashier and a swing manager) there’s always customers who have to throw a tantrum and create a scene over a botched order which could be resolved peacefully. I was YELLING at the video: “LADY-SHUT THE **** UP!!” Her yelling was driving me nuts! I almost had to take ibuprofen after watching all that!!:eek::mad:

    This happened in Park City,Illinois-up in Lake County.

    Your keyword was ((altercation)), in other words, disorderly conduct. If a crime takes place, all the rules change. In this situation, what crime did the woman commit? Listen carefully to that 2nd video. Trespass is a 2 part process. The owner or the agent of the owner asks someone to exit the property. If they leave, no crime has been committed. If they come back or refuse to leave, then it becomes criminal trespass, AND the person can and in most cases will either be arrested or given a notice to appear.

    Please don't take my word for any of this. Go search the internet about the ID laws and what constitutes trespass.

    I am sure most drivers with at least a year of experience know what a pain Lot Lizards are. In some truck stops, they would post photos of LLs trespassed and ran off in places where staff can see them. It's a shame fast food places like this can't put up photos of people like her. Just stay away.

    I'm simply basing on their voice and jewelry as most likely being female.....I don't ASSUME just stating their behavior led to consequences....:(:biggrin_25512::biggrin_2553:
