    Read the definition of On Duty time . http://www.fmcsa.dot.gov/rules-regulations/administration/fmcsr/fmcsrruletext.aspx?reg=395.2
    The FMCSA amended the definition of on-duty
    time to exclude any time resting in a parked CMV.
    In a moving CMV, on-duty time does not include
    up to 2 hours in the passenger seat immediately
    before or after 8 consecutive hours in the sleeper
    berth. This provision goes into effect February 27, 2012.

    There's a lot of ways interpretation of this is controversial.
    You can be off duty driving from your home to the terminal unless you are dispatched from home . Many of our drivers tell dispatch to let them know if they "probably" have a load . Then they will drive to the terminal off duty and be dispatched when they get there .

    If the GVWR is over 10,001 lbs, you must comply with the Hours of Service. How do you comply if no log book is maintained?

    My truck would only meet those requirements when towing a trailer. Otherwise it does not meet the weights listed. My GVWR is 9900lbs.

    When I had my authority, the DOT advised me that my truck which is a 1 ton would have to log. The other two drivers were like you with the gvwr of 9900 lbs. He advised me that they would have to show on duty not driving and limited to the 14 hour rule each day.

    Most companies have rules that require the driver to log back no matter what the weight. Their rules supercede dot.

    Thanks for the info RickG, I missed your post until now. Will definately have to discuss with the company I lease onto about this. I live about 680 miles from the company I plan to work for. I would hate to have to count that travel time as drive time.

    I always thought you only had to log it if you was under dispatch or pulling a trailer. My thought on the subject would be log while you are loaded but once you drop a trailer and have completed your delivery why would you have to log the miles back home if you are not getting paid for it. If your not under hire you are not a commercial vehicle.
