I understand your point, and a attorney to straighten things out is a good idea, my posts have been in response to the posters that think mistakes =payday.
From the OP " They apologized, stalled, and eventually offered three hours detention pay." Not really sure what else they are looking for?
I'm guessing you mean the arrest record? If so I wouldn't think anyone could do that but the person who was arrested.
I'm pretty sure messing up someone's arrest record is worse than trashing someone's DAC report....but they will probably do that too!
There will be major cost involved getting the record corrected. Like I posted, just the arrest itself can stop a driver from crossing the border. It is not just a call to get this resolved.
I'd ask why or what was the prompt to report it stolen stolen in the first place. Will it stay on the drivers record or the companies record? The law logs everything. How much is detention pay? is it worth it?
Ever been to a mugshots site? They typically put up mughstos of everyone whether found guilty or not along with the crime and then you must pay $30-$150 for each site to get the mug removed. The trouble is there are dozens or more sites and they often come up first in Google when someone searches your name. On top of that the company should have to pay for their having to be strip searched and for mental anguish. At the very least $1000 per person. $10,000 per person wouldn't be outrageous either.
