Declined for failed background (that should be clean)

    This has been an interesting 2 weeks for me. I got my CDL A 3 weeks ago tomorrow, after 5 months of school. I didn't officially graduate till last Friday so I had 2 weeks to apply and set up interviews. The place I had been wanting to go to since January, said they weren't hiring. So I sent out 20 plus applications (many thanks to the intelli-app program it made mass sending easy!!!). There was also an app you could download to track process. I kept pretty good notes and my phone went nuts but I still ended up confusing people, places and companies. All of a sudden I would get an update that I was declined for employment. One after another, after another. I'd call, leave messages and send emails with no response. The company I was most interested in I bombarded with calls and a couple emails. I guess he finally got sick of me calling and answered. He told me "I'm sorry but we can't offer you employment because of your background". "Uh my background? What do you mean my background?" I said. He went on further to tell me that I had a felony charge of aggravated assault on my background. I insisted to him that I'd never been arrested, accused, convicted, jailed or anything else relating to aggravated assault. He said there was nothing he could do other than send me a letter that I could dispute the charge. Not willing to wait a week I went to talk to a friend who is a bail bondsman and also owns a gun store for advice. He ran my background and found the same charge. The next day I took the background to the county clerks office. They looked me up by social security number and found nothing. No charge. No arrest and so on. When they looked by name they found another person with that charge but of course different social, birthdate and even middle name. Not even a close match. They gave me a certified paper saying that I have no felony on my background. Thinking this may help me I sent it over to the guy who told me about it to begin with. In hopes that I may be able to still get this position. I was ignored. I called. Emailed. Nothing. I felt so defeated. I've worked so hard for this career. For something completely erroneous to derail it. I wanted to be working last Monday.

    In comes Schneider. I always liked the company. But there were some little things that kept them not at the top of my list. Little things like no inverters, APUs, refrigerators, bluetooth phone calls (I don't like talking on the phone anyway I just didn't get it) and a couple cpm lower in pay. Perks that made other places more appealing. I had talked to the recruiter a couple times prior. She was always on it and had impressed me. Either responding to an email or phone call. Well, she just so happened to call as I walked in the door from the courthouse along if I had made a decision yet. So I just puked out everything I had been going through and how frustrated I was. She asked me to fax her the paperwork and she would take it to her legal team. Within the hour she called me back to say I'd been approved for a position. I almost felt like I'd be settling but called my wife and talked it over with her. She made some good points that Schneider went the extra mile where everyone else wrote me off. That could mean 2 things. They are really desperate or they really care. I'll soon find out as I start on Tuesday. I've spent some time today on done research and have seen many positive things on here about them. Obviously you have to take the good with the bad.

    I guess my question is has anyone dealt with false information reported from a background check company before? Online it says it's pretty common. I have some work history as a recruiter. I didn't come across it often.

    Well it does happen, Keep that letter. Give them a shot. She listened and is giving you a chance.

    You need to find out who put out the report. Make a copy of what you have and send it along to the company who put of the false information. Along with that letter you need to put in a demand that they correct their mistake as they are LIBEL (a published false statement that is damaging to a person's reputation). Make them send a retraction letter to everyone who they issued that report to. Also get them to send you an apology. If not find you local lawyer as you have damages.

    Glad to hear this worked out for you....You sure worked hard enough at it....This type of thing happens more than you'd think, as the system these guys use to check criminal history is not the NCIC that L.E. uses....In fact, up to about 10-15 years ago, companies didn't even have access to that....As you can see, it's not entirely accurate, especially if you have a common name...
    I've a couple of friends that pulled for the big pumpkin, one's still there (tanker division) for well over 15 years now, while the other fellow quit to drive a cement truck (local work).....All the best, now get truckin and put this behind you.....

    I've actually been interested in getting into tanker from the beginning. This may be a blessing in disguise!!!

    I asked for him to email me the report and/or the name of the background company. I got no response to those emails or phone calls. When he did tell me I was denied he said they would mail it to me. Who knows how long snail mail takes for that. I will definitely take action to get them to correct and try to make it right. However, I'm disappointed that 4 other companies didn't respond or call me at all to let me know. But I guess if that is how they treat people when they hire it may not be far off how they treat their drivers. That, I won't get to find out. Like I said in another post, blessing in disguise.....

    I was turned down for an apt. in Indiana a few years back. They used one of those online background companies.

    It showed that I'm a black guy (which I'm not) and that I'm currently serving time in 3 different prisons in 3 different states (at the same time) and that I was arrested for selling drugs 3 years before I was even born.

    These companies are a scam and are very inaccurate. They buy bulk info and don't even know how to verify it. In fact there's one that allows you or anyone to start your own background company, but it's really just a back door to their web site.

    All you have to do is challenege it, like you challenge a credit report.

    What's so sad, is that when you challenge it, they wait 2 to 3 weeks then delete it, on your word alone. So even if the report is correct and you challenge it, they only pretend to verify the info. but don't. They just say the info. was wrong.

    The only accurate ones are those done by the cops.

    That's illegal. Just like a credit report, they have to tell you what agency gave them the derogatory info.. It's also illegal for the companies that didn't hire you, not to inform you that it was due to a background check or credit check or dac report.

    Man that's crazy i'd almost be tempted to get a lawsuit going based on the hardships that information has caused and could still cause in the future.
