    Well, I put my money on citations and disqualifications AT WORST.........this guy is probably already so disturbed at what happened..He may not want to ever go Near a Truck again.

    Im Watching pedigree and noit4hire go round n round.........

    Not to play devils advocate here but it should be noted that California does have a “murder under special circumstances” law in the books. Even though the perp did not show intent to commit murder/homicide/manslaughter they could still be charged.

    And this was voted on by a certain colony to come up with What I Feel are frivolous charges...Or did these charges arise from a Single Prosecutor with less than stellar Logic..But a bunch of well Known Golfing Buddies..Talkin' about a judgeship in the near future.

    smh- Gotta charge someone ......Lookin' for Hope in a hopeless world.

    Giving driver life is just pandering to the public. The guy did nothing intentional to cause the deaths. He needs a very good lawyer
    If being in the wrong place because of log every driver is liable right now ,,,except for me of course
    Another reason I wont haul in USA where drivers are easy scapegoats for backwoods law

    Actually, he did. He knowingly violated HOS rules to the point of egregiously. He knowingly avoided getting adequate rest. He knowingly drove when he would have been parked if he had been somewhat legal.

    You want to run hot? Do so at your own peril. But in this case many others suffered as well.

    So, bottom line;
    Truck was in wrong place, wrong time.
    Driver of said truck was behind the wheel.
    Bus, with passengers, runs into said truck from rear.
    13 passengers and bus driver loose their life.
    Truck Driver now faces serious possibility of serious jail time.

    Since the bus driver is dead, prayers for his family, than he can't be charged for anything, got it.... So since bus driver can't be charged with murder, than lets charge the sleeping Truck Driver...... So we're charging people for crimes that may or may not have happened, if they were not there. Next it will be, charging people for crimes that they may commit in the future...

    Look, I agree that this truck driver broke some HOS rules, and we can debate those in a different thread but the bottom line is; He should NOT be charged for any murder that he did not have a hand in or involved with any planning of said murder. He can't tell the future so he had no idea that some idiot would run into his truck, that was most likely parked legal at the time he parked it, IE back up. It just so happens, that when he awoke, he was than parked illegal,,,,oops. "Dang, cant believe I didn't hear a horn or traffic going by".

    Very sad story but this is life people, stuff happens and sometimes for no apparent reason. We are human and this world turns on that notion but, some bureaucrats want to think we can live in a world of 1's and 0's. We Can't!

    No one who is normal sleeps on a travel lane blocking a interstate highway at minimum needs to be moving at or near the posted speed limit.

    I feel that murder charges are warranted here. Which is why when you and I have a difference in positions there is a court house that will have to decide by Jury what's what based on the merits of the case.

    It will be difficult to find a impartial body of 12 people in that county now. They will have to relocate the trial else where.

    He's not going to be charged with murder. Bottom line is the truck driver is as guilty as a drunk driver would be where a fatality crash was involved. If he should be "cut some slack" then we need to be more forgiving of drunk or texting drivers who kill other motorists. "They didn't intend to kill others" either.

    Or. Is it okay to drive fatigued and beyond HOS limits, but it's not okay to text while driving or drive intoxicated? I'm just trying to understand where the delineation occurs [according to some]

    No. He wasn't driving, however he was "pilot in command" of the CMV, all the same
