Unpaid Wages. Any advice?

    So sorry this has happened to you. I would say run as fast as you can to a new company. Do you have deposits at your bank you can use to verify you were making money, even better if they had this company's name on them. Where do you live?? People downgrade and ridicule Prime, but they are a pretty good place to work. I don't know what hoops you would have to jump to prove employment. You most likely would have to have a refresher course with any company you go out with.

    You should have some record of employment with these guys. Will be a PIA, but you should be able to get on with someone, as you are not the first driver that has been caught in this position. Heck, I would use it to your advantage, honestly you are the good guy in all of this, you went above and beyond to help keep this jerk's doors open.

    As far as an attorney, I was stiffed like this once, I called an attorney that specialized in the this stuff. It was two weeks pay, around $8,000. He told me to write it off on my taxes, unless I want to do this for principle. In that case, he said by time he is finished... More to the story, this involved a contract, I wrote it off on my taxes. I would do better not suing at the end of the day. Start with the Labor Board, from my experience they love dropping the hammer on trucking outfits. I have a buddy of mine that has been stiffed like this more than a few times. He got his money in short order, every time. Usually just the threat has the check in the mail, at least in his case.

    Dude, here is what I would do.

    I would apply for jobs, put them down as an employer, tell the potential employer the situation and when they do an employment check, and if there is a refusal to confirm employment, have them respond to you in writing if they refuse to hire you because of this reason. But see if you can work it out with the new employer, many times companies will overlook this bs form or retaliation.

    If they did refuse to give a confirmation or told something bad to a potential employer, I would then search out a law firm who specializes in this sort of crime, becuase it is really a crime, and let them call and record the conversations to use as evidence, because these guys will sue them on your behalf and many times they collect your back wages and damages.

    Many companies know the game others will play, most of the time the verification process is not all that important to most. Me, I do a serious background check first and then if I see problems or things I don't like I start calling. I have had other companies trash drivers and I tell them I am noting it and will tell the driver about it so they can take action against the company, that pisses the person off ... they usually hang up on me.

    So good luck, hang in there and seeing they are not paying your money, don't give them a notice when you quit, just leave. You can sue for back wages later.

    And just to prove a point I keep making here. If the company misses one paycheck it's time to move on. There is no recovering from not having the money to pay employees. That should always be a companies first priority. Equipment payment, buildings, even taxes can be pushed back a couple months if needed. All those are simply added late fees and the like. Not paying employees though, means no employees are around to make the revenue needed to get the company back in the black.

    p.s., Yes I've not bben paid on Friday once, but that was a glitch and when I called payroll they acknowledged it. I got my paycheck Monday. If it would not have been in the bank Monday, I would have spent Tuesday putting in apps...

    First Thank You for your Service, you are much appreciated.
    You worked for them for 3 years so you should have the tax documents w-2s or 1099 from them that can go with any other documentation you have.
    Other people can sign statements that know you worked for them, mechanic, etc. perhaps they will help you.
    Sue the crap out of them in small claims court that will be the fastest way to get your money if it's under the amount that you can sue for in small claims court in FL. Contact the Contact Us - Wage and Hour Division (WHD) - U.S. Department of Labor

    I cleaned out my truck and left. I have some information on them but I do not have access to some of the additional items mentioned above. I am hopeful the labor board will be able assist.

    On another note, I was operating throughout the Midwest. Born and raised in the north, so the snow is not an issue for me. I am not limited to the south. I will go where the jobs are.
