    While driving? HA.... no wonder. I think there are big fines associated with that. Really big fines.

    Not to tease or anything, The smokey probably saw the same old tired swift and suddenly realized swift truck is out of character way over on the left. Swift is not known for that behavior that lured him in to see if there was anything like cell phone use to get you on.

    This is a very old and I considered dead situation. Most phones can be voice only through the vehicle's own entertainment system now.

    Ok but the phone is not in your hand or against your ear. Right? Or no you were holding phone.

    The rule is pretty clear you cannot be holding anything in your hand as written.

    A tip, it would be easier to type out the situation in your defense as much detail as possible so many here do not have to "Pull teeth" and scroll through side tracks like this one which may or may not have a defense in your favor. There is just too much of a potential fine involve not to lawyer up and tell him everything.

    Where is it illegal to be in the number 3 lane on a 4 lane road? I’ve never heard of that before.
    Usually the right 2 lanes are perfectly legal unless posted otherwise.

    Although he did not know the difference between a citation and an inspection report, so who knows where he really was.

    DC and Virginia Loop 495 comes to mind as are parts of 95, 395 etc. It was back to the late 80;s or so there were no signage and we would own the left two in a herd. That got resolved pretty quickly.
