Application Question

    Hey all, the application reads: "Was your job designated as a safety sensitive function in any DOT regulated mode subject to alcohol & controlled substances testing requirements as required by 49 CFR part 40?" I have had many jobs where I was tested regularly for drugs and alcohol, but would I answer 'Yes' to that question on the app? Or is that STRICTLY for driving jobs?

    49 CFR part 40 is a Department of Transportation regulation. So if you did not have a commercial driving job before this one, then you would answer NO.

    For example, you work at a warehouse driving a forklift. They drug test you. It is not a DOT regulated job. So even though you took drug screens, you do not fall under the safety sensitive function of the DOT.

    The definition you need is listed at the FMCSR's §382.107

    Alright, that's all I needed. Just curious if ANY job that required drug testing would count for that or not. Thanks.

    Only safety sensitive employment as defioned by the DOT...Airline Pilots, Locomotive Engineers & CDL truck drivers...only.
