Case dismissed!

    Hey guys!
    I’ve got a question and was hoping someone had an answer for me. I’ve been driving for some years now and I have a good driving record. I was in a single vehicle accident involving a bobtail some months back. The truck had to be towed. Details on my DR say there was no damage done or injuries to report. Long story short, the case was completely dismissed in court recently. How hard will it be to find another trucking job. Has anyone else gone through this? Any response is appreciated. Thanks.

    What was the citation for?
    Did your employer terminate you before the case went before the judge?
    What was the grounds for the dismissal?

    Cited for improper brakes/reckless driving. Employer did in fact terminate me before it went before the judge. There was no evidence proving that I was directly at fault and no witnesses or others involved. Companies insurance handled all the extra stuff and just clipped me. No further contact was made after termination.

    It’s hard to say, but you can state it how it is on your driving record. You can even call the county clerk and ask what a backround check would show. You can mark it on an application as not at fault and possibly no citation issued as long as there is no evidence of such. You’ll have to be honest about why you were let go from the last company, but if you’re speaking to someone about it you can say they just have no tolerance for any accidents and no investigation was done on their part. It’s just easier to terminate. Never admit fault.

    Regardless, someone will hire you. It wasn’t a serious accident and it was bobtail. I can see it being looked past. Most applications state no more than 2 or 3 preventable accidents in how within how many ever years. If worse comes to worse there are desperate companies still, but you may not enjoy working for them.

    Lastly is the brake violation on your Driving record or CVSA score? Was the officer claiming the improper brake was on the truck or that you improperly braked.

    Just apply to companies that China can provide, this should be on your mvr but not going to stop employment,

    the problem is hiring is slow for drivers who have been out of work for a while. It is a carriers employment market, so it may take a bit.

    Drivers don't have scores, they have PSP. That's where the inspection data is stored, not on his driving record. Only traffic related data is on a state driving record (aka your driver's license directly.) CSA/SMS scores are for CARRIERS. That includes any accident, traffic violations and/or inspection data.

    Thanks for the response man. But the brake violation isn’t on my DR. He was citing me for a brake malfunction that lead to the accident but it wasn’t proven.

    Gotcha. I’m hoping it won’t hold anything up too bad. I’ve been out of work for two going on three months. I’m back on the hunt now. Thanks for the response chief.
