False logbook

    I drove 51 miles on peraonal conveyance from one reat area to the next in montana when i got yo Minnesota i got inspected and they gave me a false logbook because according to the state trooper im not aloowed to used personal conveyance while loaded im a company driver does anyone know if this citatiom carrie any points im from jersey and got the ticket in Minnesota the ticket i was told by a lawyer that is not worth fighting cause it wont change or get reduce any thoughts thanks

    Why did you use PC to go from one rest area to another?

    There is no provision in PC to go to another rest area or truck stop.

    I need more details about your hours for your log. How long were you at rest area?

    Gives some details about why you used PC, please. Also, as I understand, it is left up to the understanding of the one inspecting the log book.

    Unless the first rest area was full..Of course it’s hard to make judgment call since OP gave little to go on.

    This comes to mind..

    “Time spent traveling to a nearby, reasonable, safe location to obtain required rest after loading or unloading. The time driving under personal conveyance must allow the driver adequate time to obtain the required rest in accordance with minimum off-duty periods under 49 CFR 395.3(a)(1) (property-carrying vehicles) or 395.5(a) (passenger-carrying vehicles) before returning to on-duty driving, and the resting location must be the first such location reasonably available.”

    Did you move the load closer to the destination when you went from rest area to rest area? If YES, you are not allowed to log PC.

    He said he drove from one rest area to another and that is what I was going off of. You're right if the first one was full PC "might" be valid, but only if he got kicked out of a shipper/receiver. If he just drove, found a full rest area, then went to PC, it's still not valid.

    But yes, I would like to know what he was doing. Got kicked out of a shipper, could not find parking, etc...
