Mud flap

My drivers side mudflap is bent a little from a front end loader trying to get me out of a snowdrift is this a DOT violation.

 

Let's go back to this being in a snowdrift thing, oh and yes it probably is depending on severity.

 

is it cracked, broke, loose, or missing? Securely attached?
