Unloading issue

Have the delivery appointment for tomorrow morning. However, the broker says that it might be 2 days delay and refuses to do a cross-docking.
Is there any way to force the broker unload us on the agreed day?

 

What does your contract say?

 

You did agree to a delivery refusal clause?

Did you tell the broker to come up with more cash and adjust the rate accordingly?

 

He will pay, but we don't want to sit there for 2 days.

 

If the broker will compensate you for 2 days of sitting, then what's the problem?

I demand $900/day minimum to the truck. If you're willing to pay me $900 to sit idle for 24 hours, then I'm happy, and I'll sit down and keep my mouth shut.

 

I'll sit 2 days for the right amount of money. Show up for appointment and what happens, they refuse it and get paid to take it back or they delay it aka detention as far as I'm concerned. 48 hrs of detention should add up nice.

 

Their limit for detention is $300 per day.

 

If that is what your contract says then that is what you have to do, can't change the deal after you signed it unless the broker agrees to out of the kindness of their heart. They are under no legal obligation to pay you anything other than what is written in the contract, nor do they have to make unloading arrangements if they have a detention agreement in place.

This is why it is so important to know the terms before you sign them, and get anything you don't like changed -even if you don't think it will be an issue it is still best to have it straightened put before an issue arises.

 

Just 300 a day? That's a shame.

I wont babysit a tractor trailer for less than say 600 a day.
